Current State of the Cases
   So here is how this all played out so far simply by following jurisprudential theories: by filing the cases the Plaintiffs asserted that the defendants named were under our jurisdiction; we accepted the cases based on the merits of the cases and proceeded to schedule Hearings; one of the Defendants formally notified us of his claims to a lack of jurisdiction; we scheduled a Hearing ("Pre-Hearing Conference" actually) to formally review the arguements pro/con the Defendants being in our jurisdiction and after duly considering all points and evidence will come to a conclusion. That Pre-Hearing Conference will take place today (Friday) at 4pm (in the MU Fielder room).
   In accordance with American federal rules of civil procedure, the Defendant may make a "special appearance" to dispute jurisdiction, and thereby their attendence does NOT waive their objection to jurisdiction.

   One important thing to keep in mind is that we have accepted the merits of these cases, and the cause of action of the complaint is not currently in disputed jurisdiction. Meaning, if these defendants are found unable to represent the defense in this case, new defendants will be found. That most likely will fall upon either the ASUCD executive office, or the highest ranking student of SGAO. The point is: that ASUCD actions cannot be beyond review to its own judicial process, which is what would happen if we found there was no way to review actions taken by members of the University Employee Union. Point 2: our cases are against ACTIONS, not PEOPLE. Being the Defendant in one of our cases is not a personal attack on the Defendant, but satisfaction of the action's right to be defended by someone.

   the DISCLAIMER: this is in no way a biased opinion on the current cases, this is the procedural application of western legal theories to actual and potential ASUCD Court scenarios. I have no opinion as to whether or not it is likely that jurisdiction will be found one way or another here, or that either side will eventually win the case.


A Good Way to Procrastinate
   THIS website will give you the most recently uploaded pictures to livejournal. Reload it and you will have a new set of pictures. I find it thoroughly amusing.
   Through the above page, I came upon a website of photographs of abandoned buildings in New England which was also excellent.


In Class this Week...
   I learned... about bungholes. Well, "a bung with a hole" actually. Lets the carbon dioxide out of wine barrels. Now you know.

Making News Again
   THIS article about me in the aggie tomorrow (Thursday) is not altogether pleasing to me. I got rather the impression that the reporter, having already talked to Sara Henry and Paloma Perez, was already rather hostile towards me, the court, the cases, and the green party, before talking to me. I hoped that after sitting through a Court meetings and seeing that we were nice people she would soften towards us, but apparently not.

   Article Summary: Paloma Perez & Sara Henry expressed to the aggie their intention to question my ability to be unbiased on Case # 24. To avoid controversy I have removed myself from that case.

   When I first got the email monday that the aggie wanted to take my picture for an article, I knew it wasn't going to be a good thing. Over the course of the week I became more concerned about this, particularly once it was confirmed that the whole thing was about whether or not I should sit on the case.

   Court meetings always cheer me up though. I get piles of crap from everyone about court stuff, and then I finally meet with the other justices, all of whom have stood together in every major decision of my administration. It was very nice to hear them joking about how they won't be able to do cases without me and if I ever was removed they'd all resign in protest. I was hoping the respect the court members have for me would have some effect on the reporter, but apparently she was unphased by it.
   Also I agreed to do the administrative work to put on Case # 24, even though I won't be party to it. It would have been nice to get out of it, but I just cannot picture the case being put on adequately without my involvement. I'd like to work on training others to do that though so that when I'm gone things don't fall apart.

   Just wanted to show everyone what a few of us have been up to lately. This is an article that was on the California Aggie website and the ASUCD website last night but was removed from both sites by Creative Media. The reporter for the article (who did a great job) also stated that it was going to be printed in today's paper but it was unfortunately not. Nonetheless, here's a copy of the article taken from the California Aggie website late last night. Enjoy.

Whats Going On?
   For those of you who don't go to UC Davis or don't know what this is all about: I am the Chief Justice of the Supreme Court of our student government (ASUCD), and as such both these cases will come before the court I preside over. We have not yet had a chance to formally consider whether or not we shall accept the cases.
   What does concern me though is that Creative Media, which maintains ASUCD and the Cal Aggie (our newspaper) websites, and is a defendant in both cases, may have removed the article from both websites. I hope someone is looking into it.

Compare & Contrast: Case # 24 & 25,
   So this morning I get a call around 10am informing me that another Court case was filed in SGAO. I go up to the third floor and get the case documents. Then around 1pm I get another call.. ANOTHER case was filed.

The Defendants (and Defendant offices) listed:
Case # 24:
Vicki Swett, Alex Park (Creative Media, SGAO)
Case # 25: Vicki Swett, Mark Champagn, Ceative Media (Creative Media, SGAO)

Listed "brief description of the arguments Plaintiff will make":
Case # 24:
"The Defendants are not acting in the letter or spirit of the amendment [Constitution Article II, Section 5 & Article III Section 3.2], specifically the clause that provides for an independant count. This makes it nearly impossible for any one to analyze the data, putting the data to print on 800+ pages, available only while in the SGAO office, when a computer program is required. This violation undermines the integrity of the system because it prevents public oversight and transparency.
Case # 25: "SGAO failed to make the documents [ASUCD Constitution, Judicial Codes, Standing Rules, Government Codes, etcitera] stated within the bill [2003 Senate Bill # 48] online as of the stated date of September 2003. Specifically, the Director of Creative Media, Alex Park, and the Student Government Advisor, Vicki Swett, failed to decide how to implement this bill as stated in Section 2 of SB48."

   The ASUCD Court has yet to decide whether or not it shall accept these cases, and shall likely not do that until next quarter (as only three academic days remain in this quarter). We here at Emosnail attest that the above information has been objectively transcribed from the filed documents and does not imply any opinion of anyone but the Plaintiffs. The Defendants are assumed innocent until proven guilty.


Swearing Kalen
   Today I replaced ASUCD President Sara Henry with ASUCD President Kalen Gallagher, by swearing him and Vice President, Paloma Perez into office. This of course is the second ASUCD President (& VP) that I've sworn into office.
   Sara Henry is no longer in office ...that means I can talk about her now. ...but I don't think I will. I maintain however that the campaign to unseat me was completely bogus and motivated by all the wrong reasons. Shame on all those involved.


The Kerryman
   After inexplicably disappearing for more than three months, Sean the crazy Irishman has returned to Davis. I saw him briefly today and I'll see him tomorrow hopefully.
