   In my five years of involvement in ASUCD, I have seen a lot of extremely shady antics. As I’ve mentioned before, I do not believe power corrupts, I believe power allows the already-prone-to-corruption to show themselves. There are a lot of scandals in real government, and students love to point these out – but what most people don’t realize is that its not because the people involved in our government are more prone to corruption than your average person – its that they have much greater opportunities (and are under much much greater scrutiny, thus revealing every indiscretion).
   That said, I believe what ASUCD does is show us how badly your average ambitious person behaves when given a little bit of power. Or at least, when not behaving downright badly, it really exhibits how much their perspectives change to what is convenient for them.


The Good List
   Unfortunately, those with exemplary good ethical standards don’t necessarily stand out the way bad ethics do. I would like to start on a good note however, by mentioning those who have impressed me with their ethics:

   And now… I probably have significantly more enemies. It should be noted that I think many of the people mentioned above are very nice people in general. In particular I feel a bit torn about the “Unqualified Candidates” themselves because they all turned out to be pretty nice people and kept themselves out of any further shadiness that I know of, but it would be hard to justify not including them on the list.
   Anyway, my hope in posting this is that people who are just becoming involved in ASUCD will read it and keep in mind what NOT to do in the future.

   Daviswiki officially has the Aggie's pictures of the upcoming ASUCD presidential candidates up before the Aggie does, such sauce!


   Today user "SenateScandal" started commenting again on the contentious "Budget Hearing Scandal" (which I believe had been deleted previously). This time the situation became even more apocalyptic than before, with user "DPSforLife" eventually posting serious incriminations against most of the members of Senate (note, anonymous names such as these are extremely rare). Just a FEW of these allegations (quoted verbatim) are (and keep in mind I make no claims whatsoever on the veracity of any of these):

  • Former Senator Sean Ruel is a former drug dealer, has used steroids, beat his former girlfriend, and snorted cocaine on regular occasions.

  • Adam Barr had an intimate relationship with former Aggie reporter Aimee Theron
  • Donald Cohen-Cutler had an intimate relationship with former Aggie Reporter Aimee Theron, hmm media bias maybe.
  • Paloma Perez is heavily involved in Swords and Sandals, and smoked marijuana during the student funded ASUCD retreat. She also has a clitoral peircing.
  • Former president Sarah Henry frequently used the executive office on the 3rd floor of the MU to have sexual intercourse with several ASUCD members including former senators. She is also a member of Swords and Sandals.

  •    The entry has since been deleted. If it has been resurrected, it would be here.

       This posting caused such a stir that not long after the editing began I received a frantic call from the senate office on campus from a Senator who wanted to know what I knew about the situation and the legality of it all. Apparently over on the third floor the entry had caused mass panic.
       Incidently at this moment Senate has just begun for the day. For once I have no business there and can actually make use of my Thursday evening. I'd like to see the current state of everyone though (keep in mind nearly all of them were named in a devastating way in the entry).

       A major continuing topic of discussion on that page is why the Aggie never picked up on the Budget Hearing Scandal (that certain Senators smoked the cannabis during budget hearings). One source associated with the aggie points out this timeline:

       "...I hereby resign ... I was in the freshman dorms, I never lied about that. Fact is, I was told to go there by my Focus [his party] advisors ... and you all sit around smiling smugly as if you didn't do the same. Not only that but I know many of you were drunk during budget hearings..." -(former) ASUCD Senator Nafeh Malik (paraphrased here, I don't have an exact transcript), resigning in lieu of the campaigning in the dorms controversy.
       "wow um... I think we need a ten minute break now to recollect ourselves." -Vice President Paloma Perez. "actually... I resign as well... -(former) ASUCD Senator Sean Reul.
       "The word is FUBAR" -ASUCD Senator Donald Cohen-Cutler on his cell phone immediately after a recess was subsequently called.
       "I'm... not resigning..." -ASUCD Senator Brianna Haag, the third implicated new Focus senator, as an anxious silence awaits her report.
       "I'm resigning... from all my other positions" -ASUCD Business & Finance Commission Chairman Alan Pang. "So wait, you're remaining in this one?" -President Kalen Gallagher, interjecting in the subsequent confusion. "yes." Room breaths an exasperated sigh of relief, Internal Affiars Commission Chairwoman Kahliah Laney looks like she's having a heart attack.

       Also at yesterdays senate meeting they swore in former Focus candidate Cari Ham to fill the senate seat earlier vacated by Lead senator Adam Barr. Selection of senators to fill vacated seats is the sole discretion of the ASUCD president.


    Aggie photographer Matt Jojola ([livejournal.com profile] blueliquid13) sulks after missing both resignations, having left the room right before the excitement commenced (but he got a picture of the empty seats which I tihnk was probably more poignent anyway). Orwellian party candidates Rob Roy and Chad van Schoelandt can be seen in the back right corner.



    Jurisprudence in ASUCD
       President Gallagher ostensably vetoed the bill passed by senate last quarter to allow ASUCD Court members to write legislation. He justified it by saying that US Supreme Court justices don't write legislation, among other things.
       In response, I firstly pointed out that as the ASUCD president has until the next regularly scheduled senate meeting to veto legislation, and that has already transpired, his veto is unconstitutional. So what happens now is either the relevant government body can refuse to recognize his veto in light of its manifest unconstitutionality, or it can be reversed in a case. The former more convenient method is unlikely to occur so either I will be filing a case myself, or if I don't other people have said they will certainly file one. Obviously either way I wouldn't be sitting on the case though.
       Furthermore I pointed out that in the national arena, one has the Justice Department, the Bar Association, numerous other law related lobby groups, and armies of lawyers who love to tinker with the law. In ASUCD the only semblance of any of these is the ASUCD Court. To say the court can't write legislation is to say that no judicial legislation will be written in ASUCD, and that is ridiculous.
       Also I mentioned that Marberry v Madison in 1807 established that the US Supreme Court could review issues that inherently involved the Court, thus negating the opposing argument that if Court members wrote legislation it would be a conflict of interest for them. To this Commissioner Gordon "I was president of my JC" Fung responded that he didn't think Marberry v Madison applied in this situation. In response I proceeded to give a brief history of the circumstances and significance of Marberry v Madison for the Senate.
       Chairperson Jenni Beeman then asked why we were citing US Supreme Court cases as relevant to ASUCD. This prompted me to give the Senate a brief overview of legal theory and jurisprudence.
       In summary, it was altogether good times.

       The ASUCD Government Codes are spattered with my blood.

       I had to make what I do my best to avoid calling the quarterly Court report to the ASUCD Senate last night. Because they hate me they postponed hearing my report for a few hours. In the mean time I sat with Justice Raff and we looked up government codes relevant to things they were talking about. And we were both rather disturbed to find things relevant to two major topics of discussion that no one seemed aware of. On one the spent around an hour discussing whether or not to require themselves and future generations to attend two leadership seminars per quarter. I found in the Government Codes however, that they ALREADY ARE supposed to attend a series of training events, most of which no longer occur.

       And then they were discussing the IRS investigation against ASUCD. The mentality around the senate table seems to remain as cavalier and rightious about it as they did back when they were first warned about it. I happened to decide to look up the official endorsement policy in the gov't codes, an lo what do I find on the very back page (ie where the back cover would be if there was one):

    Section 701 - (1) In any instances where there might be a conflict, the name or symbol [of ASUCD] will not be used.
    (2) ASUCD, Unit of ASUCD, or symbols of ASUCD cannot be used in any way that might be construed as implying support, endorsement, or advancement of, or opposition to, any political, religious, sociological, or economic movement, activity, or program by the Assocated Students of the University of California, Davis (ASUCD).


       Justice Raff then showed this to Vice President Paloma Perez, who immediately responded with "we just added that!"
       Knowing her trustworthiness, I scampered down the hall to get the copy of the government codes hanging in the ASUCD glass case, which were dated September 2003. The codes were exactly as they currently are in this section. This means three things:
       (A) ASUCD has a really old copy of the government codes available in the glass case.
       (B) The codes explicitly forbade endorsements before this issue ever came up
       (C) VP Perez blatantly lied to me.
       In my excitement I pricked my finger on the pushpin holding the codes to the wall and got blood all over the place. Gruesome I know but I thought it sounded like it could be symbolic somehow.

    Speaking of the IRS investigation: I talked to the initiator of the investigation today. Everyone's favourite former president of the Davis College Democrats was in town actually and said he'd stopped by campus but fled when he was promptly set upon by people who wanted his autograph -- apparently some members of Students for an Orwellian Society recognized him immediately.

    Yesterday (Thursday) III
       Yesterday I had the misfortune of having to sit through four hours of the ASUCD Senate meeting. This was because I had to make the Quarterly Court Report, and the presiding parliamentarian, Vice President Paloma Perez and her boyfriend the Senate President Pro Tempore Chris Goran loathe me and manipulated the agenda so what ordinarily would be one of the first items on the agenda, "reports," didn't occur until four hours into the meeting.
       Perez also showed us her parliamentary skillz by speaking on substansive matters during a time when only senators, ie not her could speak, and after Senator Adam Barr called her on it, claiming she did somehow have that right.

       One major topic covered during the time I was there was whether or not ASUCD "promotes sex." Its true.
       A resolution under consideration contained the line "...while ASUCD does not promote sex..." (qualifying an endorsement of sex education for incoming freshmen) to which Senator Barr responded "I dunno about the rest of you, but I promote sex." Another senator pointed out that in order to claim that ASUCD officially doesn't support sex they'd have to have a resolution on the subject and vote on it. Eventually they concluded that ASUCD supports up to third base.
       No not really about the third base thing.

       Another major topic covered was whether or not a resolution supporting state legislation to prevent professors from indoctrinating students by requiring them to present both sides of ideological questions was inherently demeaning to students by the implication that students opinions are so easily swayed.

       Today Kristy and I saw a peacock on campus. For really.

    Making News Again
       THIS article about me in the aggie tomorrow (Thursday) is not altogether pleasing to me. I got rather the impression that the reporter, having already talked to Sara Henry and Paloma Perez, was already rather hostile towards me, the court, the cases, and the green party, before talking to me. I hoped that after sitting through a Court meetings and seeing that we were nice people she would soften towards us, but apparently not.

       Article Summary: Paloma Perez & Sara Henry expressed to the aggie their intention to question my ability to be unbiased on Case # 24. To avoid controversy I have removed myself from that case.

       When I first got the email monday that the aggie wanted to take my picture for an article, I knew it wasn't going to be a good thing. Over the course of the week I became more concerned about this, particularly once it was confirmed that the whole thing was about whether or not I should sit on the case.

       Court meetings always cheer me up though. I get piles of crap from everyone about court stuff, and then I finally meet with the other justices, all of whom have stood together in every major decision of my administration. It was very nice to hear them joking about how they won't be able to do cases without me and if I ever was removed they'd all resign in protest. I was hoping the respect the court members have for me would have some effect on the reporter, but apparently she was unphased by it.
       Also I agreed to do the administrative work to put on Case # 24, even though I won't be party to it. It would have been nice to get out of it, but I just cannot picture the case being put on adequately without my involvement. I'd like to work on training others to do that though so that when I'm gone things don't fall apart.

       So this morning I get a call around 10am informing me that another Court case was filed in SGAO. I go up to the third floor and get the case documents. Then around 1pm I get another call.. ANOTHER case was filed.

    The Defendants (and Defendant offices) listed:
    Case # 24:
    Vicki Swett, Alex Park (Creative Media, SGAO)
    Case # 25: Vicki Swett, Mark Champagn, Ceative Media (Creative Media, SGAO)

    Listed "brief description of the arguments Plaintiff will make":
    Case # 24:
    "The Defendants are not acting in the letter or spirit of the amendment [Constitution Article II, Section 5 & Article III Section 3.2], specifically the clause that provides for an independant count. This makes it nearly impossible for any one to analyze the data, putting the data to print on 800+ pages, available only while in the SGAO office, when a computer program is required. This violation undermines the integrity of the system because it prevents public oversight and transparency.
    Case # 25: "SGAO failed to make the documents [ASUCD Constitution, Judicial Codes, Standing Rules, Government Codes, etcitera] stated within the bill [2003 Senate Bill # 48] online as of the stated date of September 2003. Specifically, the Director of Creative Media, Alex Park, and the Student Government Advisor, Vicki Swett, failed to decide how to implement this bill as stated in Section 2 of SB48."

       The ASUCD Court has yet to decide whether or not it shall accept these cases, and shall likely not do that until next quarter (as only three academic days remain in this quarter). We here at Emosnail attest that the above information has been objectively transcribed from the filed documents and does not imply any opinion of anyone but the Plaintiffs. The Defendants are assumed innocent until proven guilty.


    Swearing Kalen
       Today I replaced ASUCD President Sara Henry with ASUCD President Kalen Gallagher, by swearing him and Vice President, Paloma Perez into office. This of course is the second ASUCD President (& VP) that I've sworn into office.
       Sara Henry is no longer in office ...that means I can talk about her now. ...but I don't think I will. I maintain however that the campaign to unseat me was completely bogus and motivated by all the wrong reasons. Shame on all those involved.


    The Kerryman
       After inexplicably disappearing for more than three months, Sean the crazy Irishman has returned to Davis. I saw him briefly today and I'll see him tomorrow hopefully.

       For the second time in a week the ASUCD Senate will consider removing me from my position as Chairman of the Court tomarrow (11/20/03).

       Regarding the 14 pages of emails mentioned yesterday, I ran into Senator Paloma Perez, defendant in our current case, in the hallway. She demanded that all copies of the emails be returned to her, saying they were her property. I told her that I'd hold them confidential until I could seek legal advise on the issue. She called for my removal before I came back with an answer.
       Also at the time she said "why didn't you come to me immediately when you discovered these??" to which I responded "I don't deal with things outside the Court. Its contrary to my position to personally check with the plaintiff to see that every evidence submission is okay with her."

       Incidentally, what I was advised by my law professor and my friend in law school is that since I am the author of every email in question, they are actually MY original property and are therefore definitely valid evidence.

       Anyway, the bottem line is at tomarrow's Senate meeting I will be considered for removal for the second consequtive time.


    Highlights My First Removal Hearing
       In other news: I have a transcript of my first removal hearing now.
    Senator LeVale Simpson: "Through all of this, I've come to like Fricke more. ...he seems to not be the best communicator..."
    Senator Caleb Hervey: "...he probably knows [the Codes] better than most of us here. ...His disrespectfulness is not the issue, it should be whether he fulfills his duties. We really need to consider if he is attempting to do the job that he is assigned to do. I think Fricke is doing that and, for the most part, he is doing a good job. Throw your personal feelings out the door. I have not heard enough evidence that Fricke is not doing his job well. He is bringing the Code back to where it should be, and we should aid him instead of cutting him off..." (Hervey voted FOR my removal)
    Senate President Pro Tempore, Senator Raj Gupta: "...about him being not the best communicator, we all know that ... he is a very stern person and that is his personality. It's not wrong but not well suited for a chair."
    Senator Cameron Menezes: "...I don't think he'll change his bull-headedness. ... as far as violations of the bylaws, almost all of us are in violation of the bylaws every week for not submitting reports."

       So Kristy talks me into driving her to campus to use the ATM. I'm walking to my car to do this chaufferin, and I see this really grizzly looking indian (As I think Ben phrased it, "the dot not the feather") man walking along the road.
       Such was the grizzliness of this fellow that I actually considered not opening my car until he passed me, as his trajectory would put him right next to me at the moment I reached my front door, on the driver side even. But I bravely decided to continue unaffected by him. Reaching me however, the man asked me if I could give him a ride the the UCD Primate Center, about I dunno two miles away. Now consider that that this man had given me fears of bodily harm moments earlier, and my friend Kristy was awaiting me under the eaves at Cuarto (it was pleasantly raining). So of course I said yes. Without a sign of apprehension or inconvenience, I readily drove the grizzly fellow to the Primate Center.
       I then drove Kristy to campus and back.


       Returning, I visited Ray's Food Place, got the supplies for and subsequently manufactured myself a "hell-of salami sandwich," something I of course invented like last week and noted in this livejournal. Oh and I bought English Breakfast Tea to add to my mass tea depository.


    THURSDAY
       Gave my State of the Court address to the ASUCD Senate. Good times. Then sometime later infamous Senator Gina Lee recommended everyone attent Internal Affairs Commission which had recieved a huge amount of legislation to review (including MULTIPLE constitutional amendments I believe), and immediately two other senators (one of which was Paloma Perez I forget who the other was) immediately raised their placards and warned "Brown Act!."
       Now the "Brown Act" mind you is some state legislation that forbids legislatures from meetings secretly, the general rule of thumb is that the media must be notified of intended meetings.
       Realizing manifest foolishness was once again in the air I had myself added to the speakers list. While I awaited a turn to speak AA Commission Chair Bob Gill, complained about how the students make fun of ASUCD government. "when I go home in the evening and my roommates ask me where I've been, and I tell them 'student government' they all laugh at me." Yes, he said that. oh boo hoo! Sitting next to him, wise President of the International Relations Student Assn, Shawn Foust, promptly patted him on the back patronizingly.
       So I came up on the speakers list and spoke thus:
       "I feel the need to address certain agregious misunderstandings of the Brown Act. Firstly, it addresses intended gatherings of legislators, not accidental or coincidental ones, and furthermore, the Internal Affairs Commission is a function of the government, something the media is well aware of, and something you all certainly have the right to attend even under Brown Act considerations.
       Additionally, as regards the recent discussion brought up by Bob Gill, government without internal divisions* is a terrible thing, and it is a rare thing indeed to find a public figure not regarded with cynical bemusement by the populace. Thank you.
    " And amid applause, I left the room and proceeded to Olson Hall.


       And in Olson Hall you see, the Russian, French, and German clubs once again were having a movie night. In this case the movie was "Brat" (Russian for "Brother," pronounced appx "Brot"), something I was very much enjoying and was very very vexed to have to leave at 21:15, less than half-way through, to go to the MUN Secretariat meeting. Grrawr. Odds of me ever seeing the rest? ehhh I'd say 12.6%.


    *Chairman Gill had bemoaned the polarity of our two campus political parties.
