Responding to Laughable Charges - Literally
   Also, I'd like to speak some more about my expected fourth impeachment this upcoming Thursday. I would like to issue the following statement: LOL
   I think I'll put that on a press release. The claims are so misplaced that I haven't got an ounce of fear about facing them. I'd bet money that I'm going to come out of this looking better than I went in, and it will have an inverse effect on those who called it. I'd say I'd actually be disappointed if it didn't occur, but it really is a lot of unnecessary drama and someone or other is going to unnecessarily look bad because of it (And as a matter of policy I am still going to exert the maximum pressure to prevent it from happening so don't expect my ambivalence to make it easy for you). I suppose scheduling an examination of the situation under "presentations," would still be acceptable to me and may spare Birdsall some of the shame of being utterly refuted during impeachment.
   But seriously, LOL impeachment. LOL Kristen Birdsall (this is not to be taken to imply any feelings on any matters unrelated to my impeachment; I by no means intend to imply Birdsall is lollable out of this context)


The Duality Bias
   Actually I think my biggest obstacle here is overcoming the media duality bias -- the urge to present both sides of a contention equally even if they're not equally valid. For example, as my media effects professor last quarter explained it, 99% of scientists agree that global warming is a fact and caused by people, but because the media feels they need to present "both sides," of the issue, the 1% of scientists (mostly on the payroll of the Evil industry) who contend global warming doesn't take place are given equal airtime.
   And so, I say to the campus media, considering that she hasn't given any reason to believe the Court ever had a closed meeting on the evening of the 12th, and that there are numerous witnesses that entry to the conference room was never interrupted, that Birdsall in this case is like the argument that global warming isn't taking place. Yes some people make the assertion, but the media would be more professional not to lend imagined credibility to fanciful ideas that fly in the face of overwhelming evidence.


In other news: Saturday night Chris Bunch had another party. I brought my new flatmate Vishal as well as Jason. We ended up staying until nearly 3am, at which point we rushed Jason's sickly ass back home, then raided Jack in the Box for season fries and stuffed jalepenos.

Yesterday's Impeachment
   Yesterday the Senate was to consider my removal for the third time. Unfortunately, they failed to call the removal hearing in the spirit of the brown act and protections given by the ASUCD bylaws for accused individuals, so the removal hearing couldn't go though.
   So it turns out the strongest charge against me was that Senator Kristen Birdsall thought it was suspicious and "against the spirit of the brown act" that when Elections Committee member Van Schoelandt pulled her into the ASUCD Conference room on the evening of the 12th the Court was there, along with the case plaintiff and defendant and Van Schoelandt, while meanwhile the Senate was meetings against the spirit of the brown act in a closed session that was not allowed by any of the provisions of the Brown Act OR any of the provisions of ASUCD standing rules.
   It is in fact a pretty farcical charge. The fact of the matter is that, "in the spirit of the brown act" we were variously having open meeting and mostly sitting around informally. Numerous people freely stopped by, including President Caliph Assagai, Senator Ari Kalfayan, Commission Chair Gregory Russel, and Commission Chair Genna Carnes (who will recall commenting on how small the keys on my phone are .. they're pretty ridiculously small in fact). And then there's the time I walked down the hall and announced "hey if anyone else wants to join us in the conference room we have more chairs in there" to the people sitting on the floor. I don't know who was witness to that since I wasn't paying attention to whom I was near at the time. The fact is the only person excluded from the room at any point was Plaintiff Joe Harney, when we discussed matters related to his case.
   And lets not forget that Kristen Birdsall and Chad Van Schoelandt burst into the room relatively unexpectedly for those of us in there. And while they were in there Caliph Assagai popped in and commented prophetically "well this looks shady." If it was a secret meeting, it was one really really badly kept secret. Fact is, it would have been "against the spirit of the brown act" for us to exclude these people, and we did not.
   And while this was ongoing the Senate was meeting behind closed doors for undisclosed purposes, CLEARLY against the Brown Act (the proverbial crickets were chirping when I asked if any of the senators could explain under which allowable circumstance the Senate had met), so I don't see how you can even begin to challenge ME while you have that hanging over your head. Word of advise, it'll help your case if you bite the bullet, admit you were wrong about at least that, and formally make those minutes available to the public. The Elections Committee admitted when they were wrong. I once notified the media 2 days rather than 3 days before a hearing, and despite the fact that the media was in fact present, I had the integrity to admit I was wrong, declare a mistrial, and schedule a new hearing which was done correctly.
   In summary: I am charged for violating the Brown Act by enforcing the Brown Act during a time when the Senate was in violation of the Brown Act.

Justice Dies In Silence - The Myth of Non-News
   But actually most alarming of all is the fact that the Aggie decided it wasn't noteworthy to report that the head of one branch of govenment, the head of an important committee, and two other important officers were up for impeachment. A representative of the Aggie said that they couldn't confirm whether or not the Senate intended to remove us. Let there be no question, you don't call removal hearings if you don't intend to remove someone. You don't impeach a chief justice just to ask him questions. They didn't impeach Clinton because they wanted the juicy details of his illicit sex life. On top of this, Van Schoelandt had offered to Senator Birdsall that she schedule the matter under presentations and thus not hold any of us liable for removal -- Birdsall obliquely rejected this. As such, she has quite clearly reserved for herself the right to remove any of the persons she attempted to remove.
   I mean, why make it needlessly contentious and hostile by notifying people that they are considering their removal if you are not in fact considering their removal. If we are not in fact being considered for removal, and Birdsall for some reason just loves impeachment hearings, I would ask that she officially waive her right to dismiss us pursuant of the upcoming removal hearing which will doubtlessly occur. I ask the media when she tells you she doesn't intend to remove us to ask if she waives her right to remove us. I believe this will cut through her equivication to the dark heart of the matter: she wishes to remove us without setting off bothersome warning flags first.
   While we're on that subject, aside from the fact that none of us were conclusively notified, the notification that some of us got didn't even include our names nor any other information that Birdsall thoguht she could get away with not divulging. I would like to state that its my firm belief that the names of the accused are critical (they were all blind-CCed -- their EMAIL address didn't even appear on the inbox -- and I didn't get an email at all), and I would like to ask that all other Senators make a pledge to not endeavour to keep people in the dark until the last minute if you plan to try to remove them -- tell them what the basic nature of your charge is at the time you notify them of it. I've had to ask the Senate to consider the removal of justices who weren't coming to meetings before, and at the time I notified them I forwarded them all documents related to Court attendance keeping, and what I intended to say -- its really not that hard and furthermore keeps people from feeling like its personal.


The Governator is Watching
   Justice Reed works in Governor Schwarzenegger's office. According to her, she was talking to him the other day, and mentioned she is on the ASUCD Supreme Court. To this he responded "ASUCD, they're the ones with the scandal right?"
   omgwtf! I can't believe I heard that right. I suppose its not so shocking to hear that they read the paper from the nearest University over there (Sacremento being just 11 miles away). But yeah so, The Governator is watching. I submit that he probably reads this livejournal.* =D

   Two Years Ago Yesterday: Limp-Wristed Fist Shaking - Kristy and I make an expedition into Sacramento, arrive late for a party at the Loyola House. George Andrews, famous for "saying daffy things," gives me another funny quote. The next day Little Christie has her birthday and I get sick from eating most of a large pizza myself and then drinking. For her birthday this year we went to the bar at Sophia's, and Rob Roy and I had a much needed friendly chat. Most importantly though, this entry initiated a serious debate about the proper way to shake one's fist.
   Two Years Ago Today: One Year - After one year I'd posted 332 entries (.91 / day). Since then I've really been slacking, with .64 per day since then for a total average of .73 per day. At this moment I've received 7.0 comments per entry and 1.221 comments to every comment I've made (4,606 / 5,625). Also, I pwn Professor Siverson. But most importantly this entry included the first "year ago today."
   Year Ago Wednesday: Entertainment Council Tahoe Retreat - ASUCD Entertainment Council goes on a retreat to Tahoe. In the spirit of the Brown Act, I record our adventures in a thorough photo essay. AND
   Year Ago Wednesday: Jesus Love Me, Not Ian Watson - Jesus himself tells the Bob Jones Institute that I'm cooler than them, and Aggie columnist Ian Watson gets butthurt over my aeroflot t-shirt. I write a letter to the editor in response to Watson, he makes some vague reference to it later, then plagiarizes my idea to talk shit on the "Ban Taco Bell" protestors, then gets fired for plagiarism.
   Year Ago Today: Phone Post: Internet's Out - Despite living in a freaking freezer due to a broken heater (compare to two years previous), and lacking internet access, I make a phone post to commemorate the Emosnail livejournal birthday.

   At the time, running on promises to end ASUCD corruption and shadiness, the Friends Urging Campus Kindness facebook group accrued an unprecedented 2,000+ subscribers. Since then, official leaders of the group have one by one been guillotined until only three of the original seven remained: Pete Hernandez, Kristen Birdsall, and Rob "Robespierre" Roy. For fear that the mighty banhammer would be used to squash further dissent, leadership of the group was placed under a Protection Committee and Roy was temporarily relieved of bannorizing privileges.
   I then sent out the following message: (title: F.U.C.K. Officers to be Removed by ASUCD)

Friends Urging Campus Kindness was founded in opposition to the corruption and shadiness that had been prevelent at the time within the ASUCD Senate.

Last Thursday the Senate passed legislation retroactively eliminating requirements for office so they could seat certain people. This Thursday the Senate has placed on its agenda the removal of four long-time Friends Urging Campus Kindness supporters for having expressed dissent over this.

Senators Roy and Birdsall, elected via F.U.C.K. themselves, are poised to support this action.

I urge you to tell Roy and Birdsall yourselves whether you feel this represents what F.U.C.K. stands for.

Message Kris Fricke for more ways you can help keep the F.U.C.K. in ASUCD and prevent Senate from fucking F.U.C.K.

   Now it is important to note that I do not state anything which is not true (Roy disputes that they actually intend to remove us, so I didn't say they intended to but that its on the agenda), nor do I add any kind of valuative judgements to the narration (its not the bad, evil, or unethical legislation, it is simply the legislation as its proponents might themselves describe it), and most importantly of all, I do not even call for the party members to oppose the action. I simply urge them to tell their senators themselves how they feel about this.

   As of 5:13pm today ASUCD Senator Robert Roy announced that he and fellow senator Kristin Birdsall “have defected from the [Friends Urging Campus Kindness] party and are now independents.” They are survived by various F.U.C.K. members holding commission positions. Their first action as independants may well be to axe four former compatriots, for reasons which have as yet still not been disclosed.

   Roy is also, incidently, running for City Council, and has expressed an interest in changing the name of the F.U.C.K. facebook group to something presumbably along the lines of "Rob Roy For City Council"

   All four persons set to stand trial tomorrow not only request that the closed session be open to public, but maintain that there is not usually any "deliberations" during Senate, and the only privacy rights that can be invoked are those of the accused, who have waived them, and therefore the common practice of Senate retreating behind closed doors after an "open closed session" may not take place.


   In conclusion, tis better to be independant than have to hear from your constituents.

   Previously, proponents of the override of the qualifications for office have strongly advocated that we all put it behind us, and maintained there'd be no public outrage. Today the Aggie pwned them in three articles (Senators-Elect Take Office Due to Retroactive Legislation, Editorial: Actions Diminish Associations Credibility and ASUCD Election Never Certified (letter to editor)). This evening Friends Urging Campus Kindness Senator Birdsall notified all officers who had dissented againt the Senate actions that they will be considered for removal this Thursday...

This Thursday the Senate will have my removal on their agenda.

Breaking news: Constitutional crisis in ASUCD! Senate rejects legitimacy of ASUCD Supreme Court Hearing. Proposes overriding election codes to seat disputed candidates. Moves into closed session.

Lets review:

Solutions, from least violative of the bylaws to most

A) certify the legitimacy of the case -- which would therefore loop this process through two of the three branchs of government, invoking no more violation than in effect a suspension of the bylaws effecting court quorum (a much smaller irregularity than that proposed to effect the election codes)

B) not certify the hearing, reject resignations of previous court members who are still students (this would not actually violate any bylaw as there is nothing regarding the formal process of accepting resignations, and in real life this does happen, for example the President of Bolivia tried to resign repeatedly but had the resignation rejected by Senate ... finally they let him, the VP resigned (successfully) ... the Chief Justice ended up as President.)

C) Court finds that quorum did in fact exist. (the fifth member was in fact literally in the room. This is a counterintuitive interpretation of the bylaw, but is certainly less shady than things the senate is considering)

D) not certify the hearing, consider senators to remain in offce, induct new court members next meetings

E) not certify the hearing, sit here and stare at eachother, until the end of time.

...

F) conduct a highly irregular and pointed override of the elections codes, creating massive public outrage.

Who else is love?

   Yesterday we had the long-awaited hearing for Case # 28, to resolve the Unqualified Candidates Scandal. We should have had 6 out of five necessary justices present, but Justice Konz unexpectedly resigned the previous day, and then Justice Johnson didn't show up... I got ahold of him minutes before the Hearing was to start only to be informed that he had neglected to tell me he apparently no longer goes here. We therefore had four justices, whereas five are needed for quorum. This was the subject of yesterday's document, which most of you probably dismissed as TL;DR.
   Basically the solution I opted for is to have Senate evaluate the legitimacy of the hearing and take a vote to settle the matter BEFORE we will release the final opinion (the first draft of which is written and has been approved by three of the four justices). Two noteworthy things about this opinion (subopinion?): (1) I was very pleased to have an opportunity to take a knock at Chief Justice "the Judicial Hammer" Vest's solution; (2) interestingly we are basically giving ourselves a court order in the first of the two orders at the end of the document.
   Today ASUCD Advisor Michael Tucker thanked me for rescuing him from "Hanging Chad" van Shoelace. Then Mark Champagne congratulated me on the handling of the quorum problem.
   Prior to the hearing, we received an amicus brief from a fraternity, among other sources. I was very pleased to find entities other than ASUCD officials taking enough interest to file amicus briefs -- and will attempt to avoid finding out that its probably the fraternity of someoen involved and thus being disillusioned.
   The final opinion is of course set to be announced tomorrow during Senate. Unfortunately I am to have my wisdom teeth out tomorrow morning, so if I make it to senate at all I will likely look like a chipmunk. Vice Chief Coady may have to present our manila envelope of power.


   I was just about to trek down to Newsbeat today since its the nearest source of any beverage worth consuming (namely, Jones' Soda), when what should I see in the MU but a table where some mad scientists were having people taste test different energy drinks and give them feedback. So of course I immediately volunteerinated myself. I wonder if they were weirded out by the fact that I knew what each of the unlabelled cups contained. When they asked what my favourite energy drink was I couldn't remember what "Wired" was called, the pleasant lady mad scientist told me to drop by tomorrow if I remember. I'm thinking of bringing a copy of my own thorough review of energy drinks with me.

   I'd like to add that since then (my initial review) I've tried this "Kabbalah" energy drink which is starting to show up around here, and I give it pretty high marks.


Forgotten Minutia - Things I was going to put in LJ entries awhile ago but forgot
(1) During his farewell speech Senator Eric Fox thanked Sara Henry and I for getting him involved in ASUCD -- coverage of our epic battles in the paper apparently alerted him to ASUCD's need for some Foxiness.
(2) The day after shaving my mohawk, I was saddened to walk past some punks who were loitering in front of a coffee shop in Berkeley without so much as a glance from them -- normally they would have immediately invited me to sit and talk with them. )=
(3) Moreover, while in San Diego for New Years a Navy enlistee mistook me for another Navy enlistee!
(4) Kristy and I saw the movie The Patriot (AKA Braveheart II) when she visited, and man, it was terrible. I love the part where he kills all 22 members of a British platoon one by one (while the rest wait patiently just off screen for their turn) in close combat. Its seriously worse than those Rambo movies people make fun of.
(5) I was very panicked when I learned that for my wisdom tooth removal they would be putting me out via an IV (as I have an incredible fear of needles). Kristy took it upon herself to cure me of this fear through positive reenforcement -- by prodding me in the arm with an addi turbo steel needle and then kissing me. Eventually I'd get her attention, poke myself in the arm with the needle, and look at her expectently.

   I just realized that I'd resized all the pictures from The Grad in bicubic mode by accident -- thats why they look kinda shitty. )=
   I went to turn in the Aggie's "Best Of Davis" survey at the MU information desk, and the person working there, having just been alerted to the existence of the survey, responded with "oh, its like Daviswiki." So yeah, now when the Aggie does something particularly clever its lucky to be compared to Daviswiki, the tides have turned!

   Today there was an opinion piece and a letter-to-the-editor calling for the implicated ASUCD senators-elect to step down, thus upgrading the ASUCD Scandal alert level to "orange". "Hanging Chad" Van Shoelace filed an amicus curiae brief for Case # 28 today, in which he cites this livejournal as to events involving last year's elections committee scandal and the changes that were made pursuant to it. I then cleaned up the history section of the Court page on Daviswiki a bit, and then created a Local Monarchs page to list the numerous local persons who claim to be king, queen, or emperor of this or that. As noted on the page, I'd rather you don't add any monarchs that are not either generally known (e.g. Party King of Davis Rob Roy), presumably supported by a number of their subjects (e.g. the various dorm kings), in infamously bad taste (e.g. Holy Emperor Tequila and Queen Victoria), or a combination of these.

   04-12-22: Retarded Arguments - A political correctness fascist mistakenly engages me in one of my favourite arguments: whether its unpolitically correct to call something "retarded" because it appears to either have a marginal intelligence or have been designed by someone with one. Since "retarded" means literally "slow" and clinically refers to someone with an IQ of less than 70 or something along those lines, it is completely accurate to use it to describe something characterized by lack of thought. Furthermore to demand people stop using the word requires that one equally stand against the words "insane," "idiot," "moron," etc, as they function exactly similarly.    Festivus 2004: Holidays w/ the Megabloggers - The Megablogger community reconvened for a rare non-June activity, they celebrated Festivus together via a chatroom. We all participated in the airing of grievances. We all came bonded over friendly comments such as "Apoplecticfittz - You are so full of shit. You think you are funny and are one to talk about me? You are not and are instead lame. You do not deserve merriment this holiday season, you deserve to be mutilated by a giant squid. Die plz. (I think I'd made a resolution to mention squid more in my livejournal. I should reresolve that) This year we once again celebrated Festivus together, and I think the airing of grievance comments were much less harsh (lo, we even had problems with them being downright nice!) but for some reason there was more tension in the air and several people vowed not to participate in Festivus next year. )=
   Christmas 2004: Feet of Strength - Camarillo again. Tobin nearly kills us by only packing one pair of socks for three days to cover is already weapon-grade foot oder. Also, I learn that my paternal grandfather as well reads at least some livejournals. I'd forgotten about that, holy crap. Also ran into Colleen & Colleen down at Diedrichs, Colleens seem to run around in pairs.

   In keeping with the Phi Alpha Delta tradition of having more resignations annually than there are officers, and so as not to pull a Chris Goran, I have resigned from my PAD position, effective this Friday Thursday.


   For Thanksgiving Kristy and I, and her flatmate Becca, went to Kristy's place in Pleasanton. Her mom makes awesome stuffing.
   There we actually went and saw a movie in a theatre. Unfortunately all the movies we'd really wanted to see were no longer showing so we saw Jarhead.
   Speaking of movies, every time someone refers to Sin City, which happens suprisingly frequently, I think they're saying "Sim City." And I think, "Sim City?" what kind of movie is THAT? I imagine, like the game, it starts out all good and fun but after awhile the characters begin to feel a lack of purpose and grow bored.
   We hung out briefly with Kristy's ex, Randy, and their friends from HS. It was suprisingly pleasant. I think they all overcompensated in their efforts not to make me feel awkward, for example there wasn't a single reference to my mohawk. Wtf. These certainly aren't people who see mohawks every day. Furthermore, Randy is totally the lol-cow of his friends -- even after numerous years, making fun of Randy is still a favourite activity of theirs. I mean, how can you resist when he's wearing silly little Steve Madden leather shoes.


   In other news, my friend Kris is currently working for the United Nations in Niarobi, Kenya. Like a good little UN employee, she is blogging. Having perused her blog the other day I found this picture particularly amusing. Chile donated a giant statue of an index finger to Kenya?! I wonder who got the middle finger.
   My friend Marianna is currently working for the United Nations in New York. I asked her to tell me all the juicy gossip but she said "I can't -- I'm probably being bugged." Its kind of scary when someone says that in a serious manner.

   So yesterday I had had pretty busy day that was relatively discord-free -- In accordance with the the time-table for peace we had agreed on in SPAC mediated negotiations I had turned an amendment to the MUN bylaws in to the Secretariat. But that went smoothly and by 20:30 I was settling down on the computer and everything seemed pretty mundane.

   And then Courtney Caruso called me -- The Chairman of the Davis College Republicans (DCR) was to be beheaded impeached within the hour! Quickly I grabbed my complete unabridged Robert's Rules of Order (the bible for organizational drama) and dashed out the door.

   Turns out the current chairman, one Michael Silviera, was being impeached by a group led by previous chairman Ryan Clumpner. Silviera's defense was being led by the chairman from before Clumpner, Jonathon Otero, and the founding chairman of DCR (Otero's direct predecessor), Chris Mays, even showed up (on the Silviera side), but was shortly kicked out of the room for disorderly conduct. On the Clumpner side and doing his best to straighten out the procedural disaster that was occuring was former president of Davis College Democrats, certified parlimentarian and infamous campus Republican, Igor Birman.

   The impeachment was called for by five officers who hold their DCR position ex officio by virtue of being officers of the California College Republican (CCR) organization. HOWEVER, by the DCR bylaws, none of them should be recognized as DCR officers because they had all missed the last three duly called DCR officer meetings. As the meeting had therefore not been called by a majority of the current officers as required, the presiding officer, current chairman Sutherland, would not call the meeting to order. This led the large CCR supporting contingent to become very very displeased. Eventually Vice Chairman Sutherland, a Clumpner supporter, took charge of the room over the chairman's protests. This led to the very messy situation of having two people presiding (incidently, in the index of Robert's Rules it says by Co-Chairmen only "not recommended," and thats of course when they're not diametrically opposed to one another) and no clear legitimacy of any part of the parliamentry procedures that followed.
   Under the Vice Chairman's leadership, the body (which at this point I ought to note was composed disproportionately of the pro-Clumpner/CCR side, since they had chosen to have the meeting at an unusual time and place rather than the Wednesday 1150 Hart which has been the DCR meeting time for at least 100 years) proceeded to overwhelmingly vote that the CCR officers were indeed still officers despite having missed the last three e-board meetings, and therefore the meeting was duly called, and that despite the fact that many of the Clumpner/CCR side missed too many meetings to be considered active (voting) members, they would all be considered active unless someone could prove otherwise. (I think when I left the Silviera side was demanding to see attendance sheets from the last few meetings in order to smite some of their enemies). And basically make a stunning demonstration of the fact that when a majority can do anything including interprete their own bylaws, they can really do absolutely anything they want (& therefore highlighting why the Supreme Court is so important in ASUCD!).

   Anyway, things had taken more than an hour to get to this point. Eventually they did get to a point where Clumpner would make charges agains Silviera like "he knowingly appointed someone who had committed credit card fraud as an officer" and Silviera would rebut with something like "I was informed of their credit card fraud by YOU, directly AFTER they were confirmed by the body!" I left after about an hour and 45 minutes of this drama katrina.
   I didn't have time to really determine to my satisfaction whether Silviera was the victim of a vast right-wing (CCR) conspiracy, or had truly lost the favour of the majority of the club, but it seemed clear to me that it was about much more than Silviera. I mean every chairman DCR has ever had was involved. They tried to kick their founder out of the room! (Mays informed the Vice Chairman that he'd sue him if anyone laid a hand on him to enforce the disorderly conduct pronouncement, and was left alone). It seems to me it was about the officers of CCR performing a coup d'etat and taking over DCR. From what I've heard from DCR insiders throughout my time here there has always been tension between those who thought DCR should follow its own path and that CCR is about as relevant as UCSA, and those that feel CCR is the true messiah college republicans should follow.

Update: As of Thursday morning the wiki entry had been changed -- not only is Vice Chairman Sutherland now listed as chairman, but they gunned every other officer that wasn't connected to CCR, and changed some other stuff.

Marauding Parties - my friend Kristy and I go to Jackson Pritt's party in Cranbrook Apts, which is interesting because I hadn't been to that complex since then, until Sunday we visited Azver there. Then we briefly show up at a frat party because Courtbutt is a sorority girl, but we quickly identify that as lame. Finally we show up at Rob Roy's birthday party and are shocked to find him with Sharon Zimmerman in his arms. They would proceed to be dating and even engaged up until merely a week or two ago. Now Roy's dating a freshman seven years his junior and his annual birthday party was in the official list of UCD Welcome Week events.

   So yesterday I missed the Jason Webley show at the hippie cafe because I am a frat boy. (I'd link here to Alvin saying we're all big ass nerds (BANs) in Phi Alpha Delta or something along those lines but its in a comment somewhere deep in my lj). Anyway, we were having our weekly meeting yesterday and everything was going smoothly until a certain member brought up some previously resolved drama (we'll call him The Appellant) and started trying to stick it to the officers. What was really weird about this was for the first time in a very long time someone was having an organizational judicial drama debate and I wasn't involved at all! But I certainly have a lot of experience in the area so I thought I'd at least review it.

   Now I have absolutely nothing personal against The Appellant, and despite my opinions on how the drama went down, I still have no personal opinion about him.
   So basically what went down is he kept asking the officers questions he intended to implicate them in wrongdoing and wrack them with guilt. And this went on for quite some time. The incident had already been resolved through an agreement between the officers and the member who had been found liable, but The Appellant, uninvolved in the incident, felt that he should demand recourse for the member. Anyway, through his questioning he changed what his actual complaint was to varied other things such as alleged check fraud, failure of officers to adhere to their own duties, lying to the national office, and a variety of other things all of which I believe are completely unfounded. But the point is, I think the act of changing his complaint to whatever it looked like might stick at the moment is really the hallmark of someone whose concern isn't about the original issue but just has beef with The Man and wants to try to stick it to them through any manner possible.
   Also the argument went round and round and round, often returning to things already discussed and answered. It was quite tedious. Now I've been in The Appellant's approximate position before, of alleging wrongdoing of an organizations officers (ie Secretary-General Myung's reign of terror in MUN), but I'm proud to say unlike The Appellant in the instant case, I usually kept the discussion down to about two interchanges before I made a motion or stated the action that I was going to take lest they resolve it. This was just messy.

   As to our officers, they did a pretty good job considering. My only advise would be (A) try not to get flustered and defensive (they did a good job in this really, but remaining unflustered and undefensive is really the key to making a renegade naysayer look like a nutjob1), and also (B) making a diagram of the situation on the blackboard would of made it harder for him to run around in circles with the issue and would have been delightfully patronizing.

   So thats that. Altogether our officers have handled the situation very well, and I know that they had all tried very hard to come to the best solution to the original problem. But hey we're a pre-law fraternity so you have to expect a member to get litigious every now and then.

1But in the event the renegade naysayer is not a nutjob, or the likely circumstance the renegade naysayer is myself (take note, new MUN leadership), it still makes things easier for everyone involved if you try to give the individual the most thought out and serious answers possible. On any account, if the complaintant is myself, it could lessen the enthusiasm with which I make you look like a nutjob to everyone else.

   In sarcastic reference to the several ongoing controversies I'd started last week (notably Ms Johnson and the MUN thing, and specifically the anonymous comments), I declared The War on Wrong ("we'll need some of your civil liberties for this"). The war has escalated significantly since then.

   CFC / SPAC found in my favour, the $740 team dinner was changed to an unsubsidized dinner at Chevy's, and Secretary-General Myung was obliged to resign.
   The War on Wrong had been far more successful than I had anticipated. But they say our rightious repression will only beget more obstinance. It came to my attention today that following the CFC debacle, a move to have me expelled from the club by vote of the Secretariat (the officers) narrowly failed (the Secretariat may by unanimous vote expel a member from the club).

   Today Secretariat member Gena Rinaldi, who lives with most of the rest of the Secretariat, was using a computer they all use (it has an MUN printer on it) and discovered an AIM dialogue box had been left open.
   It included an amazingly extensive conversation between (former) Secretary-General Catherine Myung and Secretariat member Shemek Pawlik (famous for stealing $10,000 from Unitrans, incidently) about how every single member of UCD could be compelled to vote against Rinaldi in the upcoming MUN election, to such detail that they even decided to get Secretariat member Kevin Gong to be the one to nominate Rinaldi for the Secretary-General position, because "everyone knows that Kevin is a parrot," and they calculated that a nomination from him would do the most damage to Rinaldi's chances. Otherwise, they have or plan to talk to every single member of the club on an individual basis and convince them that Rinaldi is a fundamentally flawed human.
   More alarming however, is their discussion about potentially defrauding the election. Myung mentions she has to appear unbiased so she can count the ballots, and congradulates Shemek in gaining the other ballot counting position without Rinaldi objecting (incidently Rinaldi thought he was her friend).

   Incidently, after hearing about these ruthless campaign tactics I noted "so thats why Kevin got elected over me to Secretariat last year" ("kevin is universally unliked"), to which Rinaldi responded, "Akila counted the ballots then, what do you THINK happened?" (Akila has fewer scruples than either Myung or Shemek). She also noted that much as I have suspected, despite her resignation, Myung still runs everything.


   Under-Secretary-General Rinaldi will be resigning today. She was planning the major Model UN conference we host in Spring, but now someone else needs to pick up on that. In all likelihood, without her dissenting vote, the Secretariat will expel me.

   To counteract this, I will introduce an amendment to the bylaws today that eliminates the ability of the Secretariat to expel members without consulting the body (it can still be done via 2/3rds of Secretariat and a majority of the membership). This amendment will hopefully be voted on next week during the Secretariat election. In all likelihood it will be too late to prevent my expulsion.

   "wow um... I think we need a ten minute break now to recollect ourselves." -Vice President Paloma Perez. "actually... I resign as well... -(former) ASUCD Senator Sean Reul.
   "The word is FUBAR" -ASUCD Senator Donald Cohen-Cutler on his cell phone immediately after a recess was subsequently called.
   "I'm... not resigning..." -ASUCD Senator Brianna Haag, the third implicated new Focus senator, as an anxious silence awaits her report.
   "I'm resigning... from all my other positions" -ASUCD Business & Finance Commission Chairman Alan Pang. "So wait, you're remaining in this one?" -President Kalen Gallagher, interjecting in the subsequent confusion. "yes." Room breaths an exasperated sigh of relief, Internal Affiars Commission Chairwoman Kahliah Laney looks like she's having a heart attack.

   Also at yesterdays senate meeting they swore in former Focus candidate Cari Ham to fill the senate seat earlier vacated by Lead senator Adam Barr. Selection of senators to fill vacated seats is the sole discretion of the ASUCD president.

Jurisprudence in ASUCD
   President Gallagher ostensably vetoed the bill passed by senate last quarter to allow ASUCD Court members to write legislation. He justified it by saying that US Supreme Court justices don't write legislation, among other things.
   In response, I firstly pointed out that as the ASUCD president has until the next regularly scheduled senate meeting to veto legislation, and that has already transpired, his veto is unconstitutional. So what happens now is either the relevant government body can refuse to recognize his veto in light of its manifest unconstitutionality, or it can be reversed in a case. The former more convenient method is unlikely to occur so either I will be filing a case myself, or if I don't other people have said they will certainly file one. Obviously either way I wouldn't be sitting on the case though.
   Furthermore I pointed out that in the national arena, one has the Justice Department, the Bar Association, numerous other law related lobby groups, and armies of lawyers who love to tinker with the law. In ASUCD the only semblance of any of these is the ASUCD Court. To say the court can't write legislation is to say that no judicial legislation will be written in ASUCD, and that is ridiculous.
   Also I mentioned that Marberry v Madison in 1807 established that the US Supreme Court could review issues that inherently involved the Court, thus negating the opposing argument that if Court members wrote legislation it would be a conflict of interest for them. To this Commissioner Gordon "I was president of my JC" Fung responded that he didn't think Marberry v Madison applied in this situation. In response I proceeded to give a brief history of the circumstances and significance of Marberry v Madison for the Senate.
   Chairperson Jenni Beeman then asked why we were citing US Supreme Court cases as relevant to ASUCD. This prompted me to give the Senate a brief overview of legal theory and jurisprudence.
   In summary, it was altogether good times.

More On Murderous Violence in Davis
   Apparently in January of 2001 a 20 year-old lad was found dead in the Kappa Sigma house in Davis with 27 stab wounds. Police determined that the stab wounds were the cause of death, but they found the knife found at the scene not to be the stabbing instrument. Investigators declared it a suicide.
   How does one stab oneself 27 times? One source even reports the stab wounds were in the back. I find this whole case extremely peculiar.

   Also, in 1985 someone was bludgeoned to death in a restroom on campus. There is currently a $6 reward for anyone that can identify the specific restroom. Anyone want to add to the pool or claim the prize? (Individuals are ineligable if identifying restrooms in which they were the murdering party. Well, they can add to the reward pool but not claim the prize I suppose.)

   Award was previously awarded to any of the several most recent livejournal picture update lists. I still reload one, occasionally, and in fact just today it brought me such amusing findings as this.

   Also with the addition of a link to this livejournal's entry regarding the Campus Judicial Board's Elections Committee hearings, we here at EMOSNAIL think we may be one of the most cited websites on Daviswiki, behind the California Aggie and Wikipedia itself. We'd like to note that EMOSNAIL staff only added one of the references ourselves - to the entry on Kris Fricke we added that he is not officially associated with this livejournal. As it is a goal the staff here at EMOSNAIL to journalistically report on local events, we are proud of the numerous times people have felt it worthwhile to cite our entries from wiki articles.


The Justice Grinch
   The Campus Judicial Board of (CJB) of Student Judicial Affairs (SJA) found in favour of the Orwellians on both counts against the Elections Committee, 7-0. Their finding was posted in the glass case on the MU Third Floor, shortly, however, the statement was found to be missing and the glass case open.


Shocking But True: In an epic procrastinatory reversal, half this update sat here for two days before I got around to finishing it. Similarly I also got halfway through writing an email on Thursday, and I might finish it after I do this, maybe.

   Today the ASUCD Elections Committee had to answer to two complaints lodged against them before a Student Judicial Affairs board. There were two hearings, with a ten minute recess between them. The board consisted of approximately several students from the SJA board. The Plaintiffs were “the Orwellians.”
   The first hearing was regarding the disadvantage the Elections Committee caused numerous candidates by saying that it was forbidden to campaign before candidates had been verified as eligible by the Elections Committee. It turns out such a rule does not exist, and moreover only one Certain Party campaigned during the effected week, gaining an arguably significant advantage thereby. What I thought was most significant about the arguments raised during this hearing was when the Elections Committee stated that the Certain Party in question could do so because they “verify their own candidates.”
   Even if it were a rule, and this Certain Party could reliably verify its own candidates ahead of time, in the interest of fairness one would have to constrain them to the same time constraints as everyone else, even if it meant that their verified candidates had to wait for everyone else to be verified – in effect the Elections Committee admitted in this that they consciously gave a huge advantage to a specific party.

   The second hearing was regarding the Elections Committee’s deletion of certain parts of the official Orwellian statement. While the Elections Committee had claimed they had taken the action to avoid a potential libel issue, the Orwellians began with an absolutely amazing barrage of evidence. [livejournal.com profile] revchad, speaking for the Orwellians, defined libel using two law books (one by an expert on contracts and torts, the other by the American Bar Assn), a quote from the ASUCD attorney, and a quote from none other than Mr Igor Birman (!!); and then, as one of the principal defenses against libel is that a statement is true, they provided no less than nine newspaper articles detailing the factual nature of the claims against former senator James Ackerman. To top all this off they cited the official United States Supreme Court opinion in Times v Sullivan, that “debate on public issues should be uninhabited, robust, and wide-open, and that it may well include vehement, caustic, and sometimes unpleasantly sharp attacks on government and public officials.”
   Also quoted, as evidence of the inequal application of the Elections Committee’s policy, was the official statement of former candidate Dana Davies-Shaw, in which quotes deriding the slates had been permitted to remain. This was significant and amusing because Dana is a member of the JSA judicial board. Though Dana had sat out from this case, it was still amusing to see the judicial board served up a quote from one of their own.
   I’m hard pressed to make an analogy for the awesome devastation of this attack, but I think one might say it was like the attack on Pearl Harbour, if the Americans had had it coming, and the Japanese caught all the American aircraft carriers at dock… and maybe even the Japanese and dropped their own nuclear bomb at that time for good measure.
   In response the Elections Committee tried to be illusive and argue circularly to the point that the judicial board sounded visibly irritated at them several times. I think my nomination for the “worst argument ever” award goes to the Elections Committee for saying that because the Orwellians could have said anything they wanted in publicity produced with their own money, it didn’t matter that the Elections Committee edited the statements submitted through them.

   The Opinion of the judicial board will apparently be submitted to their SJA keepers no later than three days from now, from whence it will be submitted to the ASUCD Advisor, from whence it will probably be edited and/or missfiled. Call me crazy but I'd rather it simulteniously be released to the Parties and (maybe) the ASUCD Advisor, as the advisor step is unnecessary, and frankly I don't trust her even with so weighty a matter. It will be arriving on her very last day here, which will mean (A) less motivation for her not to "accidently" shred it, (B) on her very last day here she'll probably recieve a document detailing the grievious error of the policies she personally caused - a pleasant parting gift from the multicephalous justice organs of UC Davis.


   Anyway, other than that, I spent the whole day in the library once again. I happened to casually glance out the window I was sitting near at one point when who should I see riding his bike across a park bench directly below, but roommate Jason. Silly Jason.
   And then the laptop directly behind me was stolen when its operator ran off for two minutes to use the restroom. Worse still, it wasn’t her computer, but her friend’s, who had also been sitting nearby. As the desks in this area have little walls around them for maximum hermitage, no one, not even the computer’s unfortunate owner who had been about two feet from it at the time, noticed the theft. Upon realization of this crime the previously militantly antisocial students in the area, all of whom would have risked their very lives to avoid interaction, suddenly became a united community of mutually alarmed and concerned students – actually talking to eachother.

   During my dinner break I consulted with Miss Kristy Heidenberger over the phone as to where I should eat. She ended up reading through the list of eating establishments in the daviswiki, which I found amusing. Eventually I gave in to the call of big juicy hamburgers and ate at Ali Baba’s again.
   I ended my day in Café Roma, which was open with free refills on coffee till one or two (we left around 12:40) with Kritsy. There we had the unique priviledge of sitting next to (Dare I say sharing a power socket with even!) the creator himself of Daviswiki.org, Mr Philip Neustrom. Life as a Library Refugee
   Now that the weekend is over I must contend with the persecution of Davis parking enforcement, as there is nowhere within several miles of campus where one can park for free for more than two hours. Additionally I had to be here at 9am this morning since the book I am using is on reserve and hence turns into a pumpkin if I wander away from the library for too long with it. So it looks like today I am going to spend the day as an itinerate Davis parking refugee, scurrying about to avoid the persecution of Davis Parking Enforcement.
   To make matters worse, neither food nor drink is permitted in the library and this is enforced in with truncheon and jackboot rigor. And the University hasn't even had the merciful conscience to locate an eatery or even small coffee dispensery anywhere near the library. And, the coup de grace of making the library an unpleasant place to spend your time -- the bathrooms are ill maintained, and lacking in toilet seat covers. I don't know about the ladies, but few males indeed will dare to sit upon a public toilet (particularly an ill maintained one!) without holy protection of a toilet seat cover.

   So far this season I have consumed a quart of eggnog. Consumption is currently stalled until I happen to be at the store again.
   Last night I dremt that I trying to decide what to get an some fictional eatery. Eventually I gave up and was like "crap on this I'm going to Togos." I then woke up and walked to Togos downtown for a tasty pastrami sandwich.
   Weather downtown this evening included a soupy fog giving everything kind of a sepiatone look with the yellow streetlamps. Also, I attended a shockingly short 15 minute senate meeting.


A Year Ago Today - an AYAT special report
   An excerpt from an entry a year ago today titled "Corresponding with Vicki," another one of those pleasant interchanges we all cherish. FULL ENTRY, includes her email to which I'm responding, and additional commentary. Anyway here is the subsequent email I sent to her:

   The eight of us on the Court would like to thank you for your concern and professionalism in aiding the Court to function properly and participate fully in a more perfect government. I will stop by the third floor tomorrow and obtain the available documents. Would you prefer that I ask the SGAO personnel to make seven copies of the material for me at that time or that I have Campus Copies do it and obtain a reimbursement from you?
   As the impartial and confidential ASUCD Advisor could you inform me as to how I may obtain a copy of the Administrative Plan or other job description / mission statement of the Student Government Administrative Office & office of the ASUCD Advisor?

In Other News: My current roommate [livejournal.com profile] wdsguy might be moving down to LA for next quarter as he may be getting a job down there with a bigger/better company (some of you may have heard of it - Vivid), so I might have an opening for another roommate next quarter if someone wants to join the endless party which is life in our wonderul apartment in the trees.

Year Ago - This Livejournal Discussed by ASUCD Senate!!
   A year ago last Saturday this very livejournal was discussed by the ASUCD Senate in my second impeachment hearing in as many weeks. The next day I made a groundbreaking livejournal entry intended for the officers of ASUCD.
   Some highlights from that entry:
      "...in testimony against me it was said that I "run a website...," implying I operate some unique news source named incriminatingthings.com or something. I think by any legitimate definition of "run," I do not "run" livejournal.com nor this particular journal. This is one of millions of journals on livejournal.com, one of 1,464,791 in fact."
      "And finally, you recall hearing read a comment by one "shid" who said "I suggest death." He has an official response for you: "Miss Henry, that quote refers to [my] inability to get laid, and has nothing to do with court proceedings. If any cute girls want to visit [me] at LMU in Los Angeles, see [Kris] after this trial." I must say, I never thought Sean's sex life would be discussed in ASUCD Senate.
   Other livejournalists also were pulled into the situation, with livejournal's [livejournal.com profile] pavelthegeek quoted during the senate meeting as calling then ASUCD president Sara Henry "probably a bitch." In what may have been my first interaction with current roommate [livejournal.com profile] wdsguy, he commented to a relevant entry stating that Sara Henry was a "hottie."

   As Sara Henry has long since ceased to be an officer of ASUCD (I swore in her successor just as I did her, and very likely I'll swear in her successor's successor...), I can now safely speculate on her and other relevant former officials.
   I don't think Miss Henry was evil per se, I honestly believe she just couldn't handle the concept of separation of powers and that she was not my boss.
   Also I'd like to mention Senator Gina Lee (whom [livejournal.com profile] wdsguy still fondly remembers as being in his opinion "extremely hot" btw). If it weren't for her absense at the first hearing I would have been removed. I'm still not sure whether she intentionally left before my hearing or it was an "unfortunate" coincidence for them. She'd always struck me as a particularly independant senator for a member of one of the parties. Anyway I think they got her to completely obey the party lines by the second hearing, but by then the majority of the party thought it was a pile of crap and voted against my removal.


AMWEST Las Vegas
   From Friday morning to Tuesday evening I was engaged in the Model UN adventure known as AMWEST. Well, about 20 hours of that was in driving there and back.
   The Honourable Under-Secretary-General/Director Mr. Nishan Bhaumik and I were originally going to set out at 8am on Friday, but we ended up leaving just after noon. About twenty minutes later we were being pulled over in Elk Grove.
   But Nishan used his special Nishan skills and the officer left, feeling satisfied. I thereupon took control of the vehicle. Three hours later Nishan was feeling zesty again so he took over once more, but two hours went by and he started seeing things so I was back at the wheel until just before we arrived at Vegas sometime after 9pm.
   So I was in Vegas then. First off let me say I hate vegas. Now gambling, I think gambling should be maintained legally, at least in certain places, as it is a great way to tax the foolish. Needless to say, I like to retain my money and not subject it to aleatory risks.
   And on the money note, Davis MUN recommended to their delegates to expect to spend a ridiculous amount of money, totalling $180 for the weekend (just for food, shopping, alcohol). I myself think I spent maybe $20 TOTAL this weekend on food.
   Anyway, from the start I vowed not to leave the hotel except for food. And I'm proud to report that I was successful in that.

   And best of all was the free breakfast every morning - omelettes, eggs, etc, made to order! Only at AMWEST of all MUN conferences to I spring out of bed eagerly in the morning with ample time for foraging.
   Also the hotel had "happy hour" with free drinks from 5:30 to 7:30 every day. Dinner break started at 5:30 every day. And people wondered why there was a problem with intoxicated delegates every evening.

   And best of all, I'm in the little store in the hotel, purchasing a red bull, when a delegate comes in and asks the cashier under his breath "do you sell condoms?" (they don't). Maybe I'm judgemental but he didn't look like the kind of individual who normally would expect a lot of action so it was even funnier. I guess committee was going well for him.

   Also, Canada and Burma were on our roll call sheet even though we were the African Union.

   Nishan and I chaired African Union, with around 35 delegates in it. Conference evaluations in the end indicated that we were "two of the most wonderful people on the planet" and also "sexy beasts."
   I got a ride home on Tuesday from Secretary-General Josha Crabtree. At one point earlier in the weekend it appeared all passes into northern california may be snowed in, and I might for the first time in my life miss classes on account of being snowed in, but by the time Tuesday came about I was fortunate enough to get home without incident.

Letter-to-the-Editor in California Aggie by Miss Christine Schachter, Elections Committee Chair:
   I have several objections to Kris Fricke's guest opinion article (see opinion, "Elections are a serious matter," Nov. 18). Fricke says he has nothing against the Elections Committee, when in fact it is extremely obvious that he has everything against the committee as well as others within ASUCD. Fricke blatantly accuses the Elections Committee of not being impartial, yet an individual of his position should have greater integrity than to make such an extreme statement without getting the facts straight. It was made explicitly clear to candidates that vulgarity would not be permitted at an ASUCD-funded event, and in no way did the Elections Committee ever refuse to generate a list of words that candidates could not use during the Senate Forum. Libelous content was removed because it placed not only the Elections Committee at legal risk, but others within ASUCD at risk as well. The Elections Committee does not endorse slanderous campaigns with ASUCD funding or any funding for that matter; and if that creates a problem with Fricke and others, they should rethink their definitions of fair, impartial and unbiased.

   I don't want to engage in a war of personal derision via the Aggie Opinion pages, but admittedly it would amuse me greatly to see any of these arguments relayed publicly. In particular I think someone ought to inform her of the true definition of impartiality before she violates herself further.

   Today has been quite the day for fighting injustice, and its only 3pm.

   Aside from the guest opinion, it appears I stumbled on some Model UN (of UCD) misbehaviour and alarmed SPAC (the official club administration here at UCD).
   At the Tuesday meeting the MUN secretariat distributed a new constitution that they want us to ratify at the following meeting. Though it was November 16th, I noticed "accepted unanimously on this 17th day of November, 2004" written on the bottem. They claim this shouldn't be taken to imply that they cavalierly expected us just to immediately ratify the document.
   But moreover, there is an existant MUN constitution. As to why they weren't simply amending that one they mumbled something aobut it just being easier this way because the old one was too out of date.

   Today I stopped by SPAC to get a copy of the old constitution. Incidently they weren't sure they could release it to anyone but an officer of the club. I find it rather silly considering that the purpose of a constitution is to not be secret. In fact the office droids had to call in a higher ranking individual to resolve the question. This officer however, took an active interest in MUN's behaviour. Not only that, but it came to our intention that the individual we were all lead to believe (in MUN) to be the Secretary-General of the club, is NOT in fact; at least according to SPAC. In fact she's not a student at all right now. SPAC is now very interested in MUN's activities and should be contacting them shortly.

   Yes this may have dire consequences for MUN, but (1) I didn't expect it to happen, I just wanted a constitution - I didn't expect they had more embarressing secrets I wasn't aware of; (2) I have faith in the system, & I do believe that the proper authorities should be notified of wrongdoing.

Guest Opinion in California Aggie: (original version)
   While I have nothing personal against the individual members of the Elections Committee, it has come to my attention that a great deal of injustice has been, and continues to be, perpetuated by the Committee. In my position in the judicial system of ASUCD people often come to me with complaints about Election matters. While these are not in my jurisdiction, I point them all in the right direction and am deeply saddened to see incident after incident end in no resolution. I do not believe the members of the Elections Committee wilfully intend to commit malfeasance, but I do believe a spirit of justice is chronically lacking in their operations.
   I am writing this not because I want to upset the members of the Committee or because I think that complaining about it is going to solve the problem; I am writing this because I want both the candidates and members of the Elections Committee to know that rigorous adherence to the rules and justice in ASUCD are goals that ARE attainable. I want you to know your rights, your recourses, and that you are not alone.
   Most alarming of all, I have had former members of the Elections Committee itself come to me with accounts of their erroneous handling of elections complaints. A former committee member I talked to had been under the impression that he was sworn to secrecy about the Committee’s actions and therefore never went public with his complaints. I think its most urgently important that the members of the Elections Committee itself know that not only do they have a right to speak out against perceived injustice, they have a moral responsibility. Once a complaint is formally filed with SGAO the Elections Committee is to thoroughly investigate and post their official finding within two days – including the original complaint, all evidence considered, and the reasoning behind the finding. In short: everything about the process is then public record.
   Another category of harmful misconception is that rules regulating candidate behaviour can be made AFTER a specific candidate exhibits a specific behaviour, and applied to that candidate retroactively. This is not in conformity with western law theory. Two recent examples: (1) certain candidates asked the Elections Committee for a list of words they could not say during the candidate forum. The Committee refused to provide a list. A candidate then used language the Committee deemed inappropriate and had his microphone immediately unplugged. (2) certain candidates had their statements altered, not for length or clarity or even libellous content (the statement was undisputedly true) but because someone apparently did not agree with it being there. In both these examples the Committee is failing to act impartially.
I find that most election candidates are unsure of this system, do not know that they can appeal Elections Committee decisions to Student Judicial Affairs Campus Judicial Board (if filed within three days), and most of all regard their experience as an isolated incident. These are not isolated incidents.
   In conclusion let me again stress that I do not believe the Elections Committee is wilfully obstructing justice and I mean no offence to the individual members. This is an institutional problem that has existed since before any of the current members were on the committee, it is born from a less-than-optimal spirit of rule adherence and bad advice. My only interest is the greatest justice within ASUCD. If you have a question or concern about any matter relating to justice in ASUCD elections or ASUCD at large, please do not hesitate to contact me. As elections are not within my jurisdiction I can thoroughly guide you through the complaint & appeal processes.
   Injustice breeds in silence. The truth shall set you free.

Commentary on the Aggie's Edits
   The original version above actually has two grammatical errors fixed that were wrong in the submitted version and despite all their changes, did not get fixed. The more grievous one is "...I mean to no offense to the individual..." Not only did they leave the mistake in there, but they DID find the time to change the PROPER (Irish) spelling of "offence" to the silly American "offense." But what I'm really bothered about is that they expanded SGAO, which I thought they might, but they elaborated it WRONG - Student Gov't Administrative Office they spelled out as "...Affairs Office." Though 99% of the campus no doubt will have no idea, the people I intend the message for and those I have to deal with on a regular basis are going to think I'm an idiot for a mistake I didn't make.
   Also they cut out a large part of what was the entire reason I wrote it - that I wanted anyone with concerns over the Committee's behaviour to contact me (the last paragraph).
   There are a myriad of other unpleasant edits they made which I believe are, without exception, to the detriment of the peice, but one more thing I'd like to mention specifically even if it ranks very low in the amount of substansive damage; I neglected to title the piece so they gave it a dumb title of their own imagining ("Elections Are A Serious Matter").
   Oh and they cut off "the truth shall set you free."
