   In my five years of involvement in ASUCD, I have seen a lot of extremely shady antics. As I’ve mentioned before, I do not believe power corrupts, I believe power allows the already-prone-to-corruption to show themselves. There are a lot of scandals in real government, and students love to point these out – but what most people don’t realize is that its not because the people involved in our government are more prone to corruption than your average person – its that they have much greater opportunities (and are under much much greater scrutiny, thus revealing every indiscretion).
   That said, I believe what ASUCD does is show us how badly your average ambitious person behaves when given a little bit of power. Or at least, when not behaving downright badly, it really exhibits how much their perspectives change to what is convenient for them.


The Good List
   Unfortunately, those with exemplary good ethical standards don’t necessarily stand out the way bad ethics do. I would like to start on a good note however, by mentioning those who have impressed me with their ethics:

   And now… I probably have significantly more enemies. It should be noted that I think many of the people mentioned above are very nice people in general. In particular I feel a bit torn about the “Unqualified Candidates” themselves because they all turned out to be pretty nice people and kept themselves out of any further shadiness that I know of, but it would be hard to justify not including them on the list.
   Anyway, my hope in posting this is that people who are just becoming involved in ASUCD will read it and keep in mind what NOT to do in the future.

   From Wednesday afternoon until early this morning I have been in Davis. The main reason for my visit was that before I filed for graduation I had to file for my minors, and I could only do the latter in person.

   This I was able to quickly accomplish once there, however. I have now officially filed to graduate with a Bachelor of Arts in International Relations with an emphasis on "Peace & Security" and "Russia / Eastern Europe," and minors in Communications, History, and Political Science. Unofficially, thats Communication with an emphasis on conflict resolution and organizational communications, and the pre-law series of poli sci.


Episode 1: Welcome to Crazytown
   Wednesday, I came in on a 1:20pm SouthWest flight and took the Yolobus from the airport to Davis. At the Woodland mall bus stop I had to change busses. While there I saw two people talking about something. I'm not sure what, but one was trying to get the other's contact information and the other was saying he doesn't use a phone because he doesn't trust the phone company not to listen in. I filed them both under crazypeople in my mind.
   Unfortunately, one of them (not the one without a phone) got on the same bus as me and sat across from me. Of course, before the bus even started moving he started tryinng to start a conversation with me. Since I was dressed up, wearing a black tie, and had my briefcase, I thought it might be hilarious to tell him I worked for the government and then answer any further questions with "I'm sorry I can't discuss that," but on the other hand I decided he'd probably get all riled up about that and cause a ruckus.
   After asking my name and what I was doing, and finding me not to be a government agent, he pointed to some construction going on on the mall. "They're being very proactive here. They're building a watchtower on the mall." "Why?" "Oh five judges, the mayor of Davis, and some DAs are accused of kidnapping someone, so everyone is all freaked out." "Really? Who?" "Me!!" I proceeded to refile him under "completely off his rocker."
   Anyway, it turns out this guy was the infamous Crazy Joe Sherman, and basically he lived up to his description on the wiki page. He spent the entire time regailing me about how he is the victim of a vast conspiracy. It seems the more he annoys people, the more he thinks their reactions toward him are part of the conspiracy, and the more he feels like he's a rightious persececuted jesus character. He said he had just recently gotten out of 313 or so days of jail, where the other prisoners isolated and persecuted him on orders from the external religious establishment (because you know middle-class Davis churches have mad prison connections!). He also mentioned that he believes God has indicated to him that his true calling is to become a teacher -- which is somewhat concerning considering that several accounts on his wiki page allude to him having a creepy predilection for the company of young males. In a tangental note, wiki user MikeDurkee apparently thinks we should overlook his many creepy and socially dangerous behaviours because he is a "warrior of god." I would like to officially point at MikeDurkee and say "lol!"


Episode 2: Cover blown!
   Yolobus deposited me at the front of the school (from the student's perspective anyway, not to be confused with the Chancellor's idea of the "front" of the school, aka the back side, where important guests don't have to behold those pesky undergrads which burden down their business of corporate research). I was immediately spotted by ASUCD President Kareem Salem (The first ASUCD President since 2002 not to be sworn in by me). I took care of the Communications and History minors but the IR and Poli Sci offices had closed early that day. Ran into one or two more people. Went home and found the apartment much as a left it.
   Suprised the Court at their Wednesday night meeting, then went with Justice Harney to dollar pint night at Sudwerks, where we ran into Pete Markevich (whom you may recall recently survived a Senate witchhunt), along with Sen. Alexandra Frick.


Episode 3: One More Senate Meeting
   I had been reluctant to go to the Senate meeting, having been to so many in my lifetime that even Brent Laabs probably has yet to catch up to me. However, the Senate was considering a landmark bill to formally give control of the judicial rules to the Court, which is kinda big thing so I decided to go for that.
   Previous to consideration of the bill, a lot of the usual antics were re-enacted for the millionth time. Since budget hearings were this weekend, a lot of organizations came to "show and tell" how awesome they are in hopes of getting fatter budgets. Some guy with a penchant for beating dead horses harangued the whole Senate at length for being vaguely associated with someone who had during their free time expressed the political opinion that current policies are not satisfactory to ensure the safety and documentation of all immigrants. I found it highly ironic that his main point was that he thought the DCR event was immature, but I found it pretty immature that he was rightiously chastising the Senate for something they had no control over.
   Then representatives from the Muslim Student Association pre-emptively began defending the anti-semetic speaker they'd brought to campus, while at the same time attacking Jewish Senator Eric Friedman and the DCR immigration event. In short, business as usual.

   Anyway, eventually the bill came up and passed relatively quickly. I thought it was kind of ironic that they made the change in the obsolete Judicial Codes, which will soon be completely abrogated, rather than the general Bylaws or somewhere else where it'll remain, but it was largely symbolic anyway.

   Quote of the Day: "You're the reason people don't take ASUCD seriously" - Brent Laabs to Commissioner Jill Weinstein after she expressed the opinion that ASUCD is just a glorified student club, rather than possessing any semblance of the legitimacy of a governing body.


Episode 4: Scrabble I
   After the meeting, several Senators, Justice Harney & I went to Sen. Dan Xie's house to drink and play scrabble. Since Joe and I were the ones getting the alcohol I of course brought them steel reserve (though Joe also selected some hard lemonade).


Episode 5: Campus Life
   Friday afternoon there were people with a big sign evangelizing by the flag pole, which is not terribly uncommon. However, in this case they were PASTIFARIANS bringing the glorious messege of the Flying Speghetti Monster to the unsaved! True heroes of faith whom MikeDurkee should have a frank chat with.
   Upon investigation these people were not affiliated with either Campus Crusade for Chaos & Confusion (C4), or AGASA, but were in fact merely persons whom the Flying Speghetti Monster in His sauceness saw fit to reach out and touch with His noodly appendage. Their unaffiliated status is clear evidence of the Truth of the supposition.
   Also there were some people in a bathtub on the quad wearing feathered headdresses. Typical. Eventually I noted that Rob Roy and Elise Kane were over there and said hi to them. (Here's a picture of both the Pastifarians AND the girls in the tub)


Episode 6: Life in the Trees
   Friday evening the internet went out at The Trees, which is just so typical. It didn't come back all weekend. Moreover, the internet connection was still there, it just wasn't recognizing the hardware address (MAC address) of mine or my roommates computers. This has been a frequent problem throughout the time we've had this provider, especially on weekends when the tech support is out, which once one actually gets ahold of the tech support is usually resolved by them simply resetting their system. Notwithstanding, you should rent my room at the Trees!!
   Anyway, Friday evening I took a nap in hopes the internet would come back, as I had no other form of entertainment in the midafternoon. By 7 I was getting desperate and decided to take the bus to campus to use the computer labs.
   I took the 7:18 bus in, only to find the computer labs close at 6 on Fridays! I could have sworn they used to be open till ten on Fridays. Anyway, there was still free wireless on campus but my laptop was at home and the bus I'd just come in on had left already. I waited for the next bus, the 8:10, until 8:20, when another person waiting for it suddently exclaimed that they'd forgotten the busses were no longer running since it was Friday evening. This left me with an hour and a half until I had anywhere to be. I called Justice Wheat to see if I could come over early for his shindig, but no answer. Despite the fact that that location was near campus, I started walking home because I had nothing better to do. It took half an hour to walk home from campus. It being then 9:00, I'd have had to immediately turn around and head back had John not called me at that point and said he could pick me up.


Episode 7: Scrabble II
   When I got to John's place, two of his roommates were trying to punch a second hole into a coconut ("double penetrate it"), and into which they then poured rum to make genuine coconut rum. They didn't like the result terribly much so I ended up drinking from the coconut all night. After I finished the original coconut rum I just poured whatever I was drinking into the coconut because it was funny. This resulted in some comments about my nut being sticky, along with other comments about people handling my nut, writing on my nut, etc.
   Anyway, despite the fact that John aimed to keep it "low key" a good amount of people showed up (but not too many, just enough to be awesome), and it was quite fun. My friend Shemek (who was a campaigne manager for the original Lead slate of the Huerta presidency -- but left ASUCD in disgust over their rampant corruption) joined me there. John Wheat and his fellow English-tutor coworkers from the Learning Skills Center played scrabble, but others were reluctant to engage such English aces in such a game. I thought it was funny that when the ASUD officers played the game, they argued about the rules and what the definitive set of rules was and other governance related questions, while the English majors got into arguments about what parts of speech certain words were.
   Anyway, it was good fun. Good work John Wheat & roommates.


Episode 8: Daytime Ruckus
   On Saturday Shemek and I hit the Hunan's Lunch Special around noon . Then we met up with Miss Rosejean Weller. Since we three were former Davis MUNers, and the Davis MUN Conference was currently ongoing, and especially since fellow former Davis MUNers Akila Radhakrishnan and Nishan Bhaumik, we resolved to crash the conference. Then the idea got better when someone suggested we do it drunk. So it being around 2pm we got some 40s of steel reserve and drank them, along with some jagermeister. And we were good to go!
   After this, the three of us went to woodstocks for more pizza and beer. Finally after a good afternoon of good ruckus causing we parted ways. I then returned to the conference for a little bit and guest spoke as a Russian representative. I may have still been a little inebriated, but that may have been an accurate portrayel of the Russian government. ;)


Episode 9: A Formal End
   Just as I was getting out of MUN, Brittawater Segerstrom called me and said I should come over and go to a volleyball formal with them. Which was pretty random but it was only a $12 formal and I didn't have anything else to do, and happened to already be dressed up for the MUN conference.
   Over at the M Street I joined Brittawater, Julie Parker, Kim Bowles, Sarah Jones, and a number of others.
   Eventually we walked from M Street to the event at the Senior Center. As there were initially more than a dozen of us, this took awhile, and by the time the front of our group got there the back had disappeared completely and some had found a ride somehow.

   Anyway, after being there for a little while the group consensus seemed to shift towards a hankering to go to the bars, so once again the group set out on foot, this time towards Froggys on G Street. This brought the total walking distance up to 2.1 miles, and everyone still had to find their way home again (returning to M St would bring it to 3 miles. I don't envy the girls in heels).
   Eventually I walked with what was left of the group back up to fifth street, where they turned toward M and I turned to start my own 3 mile journey back to the Trees (since the airport shuttle was picking me up there at 5:15, crashing on a couch was not an option). Fortunately I happened to completely coincidently run into one of the girls who'd been with us earlier around Central Park. She had struck off by herself toward the Colleges but had felt very uncomfortable making the journey alone and so had called a guy friend, who happened to show up almost simulteniously with me running into her. As he was giving her a ride I managed to get a ride with him as well, which was quite a relief since I still had a very long way ahead of me.


Episode 10: The End
   Airport shuttle picked me up at 05:15am and my plane departed at 7:35am. Altogether, I had even more fun up in Davis than I thought I would. It was great seeing everyone again. There's so much more going on up there than down here in OC. I can't wait to come up with an excuse to visit again!

Terrorism, Imprisonment, & Battery - A Typical Week in ASUCD
   So the California Aggie ran their story today on last week's ASUCD antics, and I really must congratulate them on upping the drama ante: Apparently last week's ASUCD adventures included terrorist threats, unlawful imprisonment, & battery!!! Either Comptroller Kai (pictured) or Senate Candidate Peake could be subject to up to a year jail time!

   The Aggie also had an incredibly short article on the ASUCD Candidates Forum last Wednesday. Interestingly though:

   Rob Roy, an independent candidate, said he would not name all the ASUCD commissions, a question posed to him by the event's moderator.
   "I can name all the commissions that you're asking, but I'm not going to," he said. "Let's talk about what we need on campus."
   For his closing statement, Roy leapt over the table, seized the microphone, and paced back and forth as he decried LEAD and Student Focus slates for being too dominating of the ASUCD elections.


Burritos vs Sandwiches
   In other news, the delightful Kristy Heidenberger has brought it to my attention that a Massachusetts Superior Court has found that burritos are not sandwichs. Judge Locke described burritos as "typically made with a single tortilla and stuffed with a choice filling of meat, rice, and beans," (and offered at low low prices!).

    The Journey Home
       I was up most of last night reading about people with names like Vercingetorix, Vortigern & Catigern. Then, since I've managed to accumulate some important tasks at the Courthouse I had to go into work. Finally I escaped from there, but had to AMPAC Governor-General Sameer for an hour on the phone about the conference we are in charge of putting together next April, which was all good and well but it was hellorz hot out and I really wanted to go home and take a nap. Then I got home only to find someone parked in my parking place. The office determined the offending vehicle belonged to the guy who should have the spot next to it. When maintenance man Modesto contacted him regarding this, the guy said with attitude "well someone was in MY spot," as if that justified it all (and I hope you all know that you are retarded if you think it solves anything by parking in the person's spot next to you when someone has parked in yours). Finally I made it into my apartment only to find two catsup smeared plates belonging to my flatmate Jason on the livingroom floor, where he seems to think they belong.
       This latter offense is in clear violation of the policy my roommates and I had agreed to unanimously, that dishes must remain in one's room if one cannot clean them immediately. I've decided my current policy for dealing with this is moving the dishes for him when he's not home ... onto his bed.
       Also the solution to the best way to confront him regarding the fact that he's in flagrant violation of something he just recently agreed to with minimum awkwardness came to me after some thought... next time he's home and I find him in a clear violation of policy, or if he asks me about my relocation of dishes to his room I think I'll ask him in an earnest manner if he thinks the policy is too draconian and needs to be changed. That way I will come across not as accusatory but compromising, while he'll be faced with either feeling like a complete flake by saying this simple policy is too difficult (which I really doubt he'll do), or reaffirming the policy in direct reference to his plate behaviour.
       Anyway, then I was finally able to take a nap, but in my delirium was unaware that I'd left my phone in my car so I missed a call I'd been waiting for regarding some stew. )=

    30 in 30 III
       Anyway, the result of all this is that I'm not really feeling like a top-notch slinger of hilarity at the moment, so 30 in 30 III is off to an inconspicuous start for me this year.

       Anyway, you may all be relieved to to know that one of my goals for this 30 in 30 is to try to steamline my blogging by spending no less than 30 minutes per post (30 in 30.. IN 30?)

    Meanwhile in the real world
       In other news, last friday we had the initiation party for the newest batch of Φ A Δ pledglings. On Sunday I went to recently-former Califorina Aggie Editor-in-Chief Matty Jojola's party. It was a very interesting mix of people, with four guys wearing Davis Players Society polos hanging out with Kalen Gallagher in one corner while from the opposite side of the political spectrum city council candidate Rob Roy campaigned in the kitchen wearing a suit & tie. I got a scandalous picture of him eating a watermelon rind with some girl, as well as another of him giving someone a classic politician handshake, I'll put them up when I get a chance. Also my fellow justice & reverend Tim Coady was there, marrying people at random and granting indulgences.

       On Tuesday most of the Court came to the Internal Affairs Commission to discuss their opinions on the Court. Also this day we were reinforced by an editorial in The Aggie advocating that our Court be strengthened rather than abrogated. IAC was unwilling to concede anything, but none of them would speak in support of any of their arguments (other than that ASUCD is a business), preferring rather to try repeatedly to end the whole conversation by saying there was no legislation regardnig the subject. Aside from the fact that the discussion the preceding week had ended with "we'll talk more about this next week," I've certainly been around long enough to know that there's always "no plans," until suddently there are, and the plans are never put forward until after the political maneouvering stage.
    nbsp;  Also they made an obvious effort to put us off as long as possible, which I thought was kind of petty & desperate. Regarding ASUCD as a business, it went around a few times until Chairman Harms announced his revelation that "ASUCD is not a government OR a business, it is an association." To which I responded that that was great but "what we are specifically arguing about here is that Kai Savaree-Ruess said ASUCD is 'not a public institution ... but in fact a business,' and a Court has no place in a business. If you say we're not a business but an association, you're not backing Kai's argument that I am here to counter..." I believe 90% of arguments improperly lost are lost because one allowed the opponent to change what the argument was about.. never let them get away with this.

       Anyway, since then Paul Harms has ceased to be the Internal Affairs Commission Chairman...

[livejournal.com profile] apoplecticfittz began with a new version of his recent Frasky Awards; [livejournal.com profile] lerani started with an amusing story about a retarded lawyer that managed to exponentially exacerbate her own ethics violation; [livejournal.com profile] fragglerocker84 started out strong with a well composed entry apparently about people on her vollyball team (its very well done for its subject matter, but the subject isn't the most interesting to random bloggers); and [livejournal.com profile] feuders also vows for the course of 30 in 30 to drink no beer (except for a number of frequent exceptions), eat no fast food, and run five miles every day. Additionally, [livejournal.com profile] jdryznar declares he's going to make 30 posts in 30 days about politics, while [livejournal.com profile] incomple also just posts half baked ravings against conservatives (at least for the first five I checked today).

    ASUCD: Not a Government?
       So I went to the ASUCD Internal Affairs Commission meeting yesterday, to counteract the arguments made last week about how ASUCD does not need a Court.
       It is unclear whether the discussion last week was pre-planned, or just kind of happened. IAC commissioners first said "we were just kind of getting ideas out there to see how we felt about it and then we were going to talk to you if we wanted to do something," implying a planned discussion, but later other commissioners said it just randomly came up and bristled at the implication that they couldn't randomly bring up whatever they want. The minutes are unclear, since they indicate a jump from talking about something completely different to an in depth discussion about why we don't need a court with no transition at all.

       Commissioners insisted at length there was no room for a Court in a "business model," I tried to point out that it says in the first article of the ASUCD Constitution, and in the ASUCD Administrative plan, that ASUCD is explicitly not a business, but the commissioners didn't seem to be very open to seeing ASUCD as anything but a business... and businesses don't have Courts.

       I was also asked "how non-elected officials can serve this purpose." Honestly I wasn't at all prepared for such a complete lack of understanding of the American government system. Next week we are going to be prepared with choice quotes from the Federalist Papers.

       There were also some choice quotes in last week's minutes, such as "I have no respect for their legal opinions" (coming from "The Goodly Kai" himself I think). I'm going to try to get my hands on a copy of those minutes for more in depth review here.

       Next week its Round III at IAC, 5pm Monday in the MU Garrison Rm. Should make for an interesting debate about the very nature of ASUCD.


    UCDMUNC 2006
       This weekend we hosted the UCD MUN Conference. I chaired Special Political & Decolonization Committee (SPD), discussing Chechnya & the Spratley Islands. I forgot my camera the first day, so I only got pictures of the clean-up afterwords.

       Like I said, my camera is working again. This is the Yolo County Superior Courthouse, where I spend much of my time these days.

       Note the POW/MIA flag that flies in front of the Courthouse. It always seems to me that this flag must seem slightly ironic to the many who come and go from the Courthouse in chains.
       Incidently, Wikipedia doesn't have an entry on the POW/MIA flag. I've always wondered what the deal is with it.










       All in all the Courthouse is kept pretty spotless. This is the only graffiti in the restroom. Given that its in a pretty visable location and it appears that graffiti around it has been erased, I think the maintanance people have found it amusing.

       On my first day working there my supervisor Gail looked over the filing I was doing and remarked "good, it looks like you're doing it all right ... but of course if you weren't it would be my fault for improperly instructing you." This struck me as a particularly enlightened philosophy others should take note of -- that if one has subordinates and they are operating sub-par, rather than blame it all on them, the ranking individual should consider it entirely their own responsibility to ensure quality operations.


    In Other News:
       (1)Contention continued throughout the day on the Rob Roy / Talk page regarding whether the wiki would include any references to his allegedly racist public statements. Thomas Lloyd repeatedly declared himself to have won the argument and deleted all references he found offending, but I wouldn't let him get away with it. Then Lloyd dropped the Libel word, which is becoming somewhat like Godwin's Law on the wiki1 I think (the Abebnego Woods troll alleged libel the other day as well), and illustrated his point with a link that clearly damaged his own point.
       Lest you get the wrong idea, it should be noted that I have not added any of the disputed content myself, and am not saying I think he's a racist; I am standing against the suppression of unfavored viewpoints & a double-standard in reporting.

       (2)Jurists across the world were saddened the other day by the death of Slobodon Milosevic while in custody in The Hague. Slobo's death denies thousands of the justice his conviction would have brought them.

       Year Ago Yesterday: Senate Finds Chief Justice to Have Jedi Powers - Sen. Darth Lloyd was instrumental in convincing them that I used mind tricks to cause 9 Internal Affairs Commissioners & 12 Senators to think that a 5 line Bill meant the opposite of what it actually meant. And I would have gotten away with it too if it hadn't been for those pesky kids "your mind tricks don't work on me" Kalen the Hutt! Also the Lebanese Prime Minister tries for the second time to resign, but once again his resignation is rejected by the parliament.

       On Friday Velvet Teen played in the Coffee House. Unfortunately the UC Davis Fascist Enforcement Service was abundant and enforced the maximum capacity of the CoHo which is strangely rated to be "full" when it is barely half full. Extensive people smuggling was carried out however and I think eventually nearly everyone who waited around long enough was able to get inside.
       So it seems the prevailing indie fashion these days for guys now is wearing a blazer, in addition to the alarmingly tight jeans and moratorium on shaving for at least two weeks prior to any public appearance. Now the blazers aren't nearly as disturbing as the tight pants, but its still rather bothersome to me I think just in that its so obviously the latest fad, and I hate things that are obviously the latest fad.


    This Week in Wiki News
       Sporadic fighting has broken out throughout the week over references to the ASUCD Gulag. Previously, as I had intended it, there were links to a page by that name, but no actual page there. This created the appropriate level of ominous official denial. Wiki messiah Phil went through and broke these links, to which I responded that this was the way I intended it, and Travis "Scrooge" Grathwell went back and broke them again. A page was created by third parties but subsequently deleted again. As it currently stands there's a link to it from my personal page now though, where wiki ethics would indicate no one can touch it.
       It was discovered that references to allegedly racist remarks by Sen. Robert Roy had been snuck into his userpage, and efforts to suppress this information has spilled over to a talk page.
       Probably more interesting to readers here, it was also discovered that one Abebnego Woods had claimed Kris Fricke to be genocidal, sexist, and egotistic, because he dared imply Celeste Rose didn't deserve half a million dollars. For some serious lulz scroll down here and read the interchange.


       Currently upcoming scheduled events are as follows: 03/18/06 Aaron Aviv's B-Day / allegedly he may be coming to Davis for it!; 03/23/06 Franz Ferdinand Show (in SF); 03/24-27/06 Las Vegas Roadtrip with Kristy's friends; 03/28/06 Spring Qtr Starts )= ; 03/30/06-04/02/06 AmPac MUN Conf in Los Angeles. My car might actually be fixed by this Wednesday, so I might be able to drive back down to OC this week or next, especially if Aaron doesn't end up coming up here. I'm not sure I want to put the car through the stress of such a drive immediately upon getting it back from the mechanic however. In conclusion I'm not sure when or if I'll get myself down to OC for Spring Break. )=

    Kitten News: The other day Kristy put a pillow on her keyboard when she left so Bailey would be prevented from playing pranks on her computer again. When she came back however, Bailey had knocked the pillow aside ... and opened an instant messenger window to ME! <3

       Somewhere, someone is about to get an eviction order signed by "Kris Fricke, Deputy Clerk, Yolo County Superior Court." I feel so proud.
       The Conaway Ranch case is back... a "petition for writ of mandate to the California Court of Appeals Third District" was lying on top in a cute little red binder ... looks like its getting appealinated. I read most of the petition on my break, it was only 11 pages, and quite saucy.


       On Friday night Kristy & I went to the "Thank God the Elections Are Over" party. Even though it was at Lead candidate Genevieve Carnes' place, I think there were more independants than Lead party members there.
       I think independant candidate Jeremy Ross tried to hit on Kristy. Later, when I introduced myself, his friend was like "you're the guy from Emosnail!!"


       On Sunday night Kristy and I went to "Rock It," the indie rock night at The Grad.


    In Other News: Me mum & father recently visited my great-aunt (my dad's aunt) in New Orleans. Mum wrote a nice little entry about it (with a couple pictures of damage).

       At the time, running on promises to end ASUCD corruption and shadiness, the Friends Urging Campus Kindness facebook group accrued an unprecedented 2,000+ subscribers. Since then, official leaders of the group have one by one been guillotined until only three of the original seven remained: Pete Hernandez, Kristen Birdsall, and Rob "Robespierre" Roy. For fear that the mighty banhammer would be used to squash further dissent, leadership of the group was placed under a Protection Committee and Roy was temporarily relieved of bannorizing privileges.
       I then sent out the following message: (title: F.U.C.K. Officers to be Removed by ASUCD)

    Friends Urging Campus Kindness was founded in opposition to the corruption and shadiness that had been prevelent at the time within the ASUCD Senate.

    Last Thursday the Senate passed legislation retroactively eliminating requirements for office so they could seat certain people. This Thursday the Senate has placed on its agenda the removal of four long-time Friends Urging Campus Kindness supporters for having expressed dissent over this.

    Senators Roy and Birdsall, elected via F.U.C.K. themselves, are poised to support this action.

    I urge you to tell Roy and Birdsall yourselves whether you feel this represents what F.U.C.K. stands for.

    Message Kris Fricke for more ways you can help keep the F.U.C.K. in ASUCD and prevent Senate from fucking F.U.C.K.

       Now it is important to note that I do not state anything which is not true (Roy disputes that they actually intend to remove us, so I didn't say they intended to but that its on the agenda), nor do I add any kind of valuative judgements to the narration (its not the bad, evil, or unethical legislation, it is simply the legislation as its proponents might themselves describe it), and most importantly of all, I do not even call for the party members to oppose the action. I simply urge them to tell their senators themselves how they feel about this.

       As of 5:13pm today ASUCD Senator Robert Roy announced that he and fellow senator Kristin Birdsall “have defected from the [Friends Urging Campus Kindness] party and are now independents.” They are survived by various F.U.C.K. members holding commission positions. Their first action as independants may well be to axe four former compatriots, for reasons which have as yet still not been disclosed.

       Roy is also, incidently, running for City Council, and has expressed an interest in changing the name of the F.U.C.K. facebook group to something presumbably along the lines of "Rob Roy For City Council"

       All four persons set to stand trial tomorrow not only request that the closed session be open to public, but maintain that there is not usually any "deliberations" during Senate, and the only privacy rights that can be invoked are those of the accused, who have waived them, and therefore the common practice of Senate retreating behind closed doors after an "open closed session" may not take place.


       In conclusion, tis better to be independant than have to hear from your constituents.

       Previously, proponents of the override of the qualifications for office have strongly advocated that we all put it behind us, and maintained there'd be no public outrage. Today the Aggie pwned them in three articles (Senators-Elect Take Office Due to Retroactive Legislation, Editorial: Actions Diminish Associations Credibility and ASUCD Election Never Certified (letter to editor)). This evening Friends Urging Campus Kindness Senator Birdsall notified all officers who had dissented againt the Senate actions that they will be considered for removal this Thursday...

    This Thursday the Senate will have my removal on their agenda.


       I have no idea what I'm charged with.

       I oftentimes find myself wishing I wasn't part of the highest judicial authority in ASUCD -- wishing that there was some appeal above me. Unlike everyone else, I don't get the priviledge of being vindicated by being proved right by higher court.
       Former senator Darth Lloyd says "The Court's improper action was the reason for removing its authority. What Kris's proposed action overlooks is that it violates the constitution," and [livejournal.com profile] senatorroy says "had they not requested Senators elected in Fall 2004 to still sit at the Senate table to determine the legitimacy of the court’s opinion, despite that the constitution explicitly states no Senator’s term shall last longer than a year, then I would have heard the court’s opinion." Now, of course, the latter quote would seriously have any lawyer or elected official ROFLing their asses off (since the method he's disparaging is how its done in every "real world" situation), but I hate to depend on the involved to take my word for it (they evidently haven't anyway)(as to the former, it is literally impossible for the Supreme Court to violate the Constitution, I know this answer is unsatisfying, thats why this entry is about my wish for vindication). When we amended the judicial article of the Constitution last winter I personally was in favour of allowing cases alleging the Court was in violation of the Constitution to go to the Campus Judicial Board, but that didn't happen, due to concerns about subjecting our judicial system to an administration body.
       Furthermore the fact that any idea that comes up in Court is in a certain sense appealed instantly to the other justices seems to be given no weight. I've only been in two meetings with the other justices so far, so you can't honestly allege they've all fallen to my jedi persuasion yet. The first thing I always tell all new justices is "we have what is written, and everything else, even what I'm saying right now, is just an opinion," and the second thing I say is "never feel like you can't disagree with me, even adamently," and on every substansive matter I never speak first. When the justices were all confirmed by Senate, the Senate could have implaced justices that would take a very strict literal interpretation of the bylaws a la former Justice Raff, but at that time they chose the people whose opinion they now discard. All this is to say I find it silly that the Court is seen as my opinion (see first quote), or to imply the Senate knows jurisprudence better than us.
       Anyway, despite these things, I am confident that an analogious body would absolutely uphold our rulings, if not find in a manner even more unpleasant to our detractors. If any senator wishes to take me up on this, I welcome you to arrange for either (1) the Courts of any two other UCs to consider the constitutionality of our rulings, or (2) an ad-hoc Court of the collective Chief Justices of the UCs (minus me of course) to consider the constitutionality of our rulings. It would of course be informal from their end, but if they find against my court I'll see to it that our rulings are retracted and future rulings more limited (and at the very least I'll admit to being completely pwned - though be prepared for the same). Though arguments will probably be made electronically, we'll come up with a fair way to moderate that, and the selection of any two Courts must of course not take into consideration how one expects each court to rule. I have not communicated with any of them regarding this case.
       Or another similarly fair system would be acceptable to me if someone thinks of something. The bottem line is: we are the Court, we are your judicial authority, and we fully believe that our opinion has been as just as possible and would be vindicated by an analogious body.
       The truth shall set you free, and history shall justify me. (=


    In Other News
       Kristy and I went to another party at Sarah Jones' place Saturday night. The theme was "ghetto" so Kristy and I got all ghettofied (archival footage of what it may have looked like). My camera is still out of commission but hopefully we'll pull some decent pictures off someone else's camera. I wore my wallet chain around my neck as "bling" and wore a a sideways baseball cap. Kristy wore a pink bandana on her head, lipliner without lipstick, and sagged her sweatpants (exposing her "rubber ducky" boxers). It was good times. Someone puked in her cup when she set it down (omgwtf?!). Eventually for unclear reasons the power went out (not due to the circuit breakers?) and everyone dispersed.

       Just two more things on the ASUCD situation: (1) Its not democracy if you don't know important details about what you're voting for. I mentioned this passingly the other day, but since then its occured to me that its actually pretty important, considering that the rallying cry of the Senate is "this is the democratic way" and "they were elected!" (2) (i) [livejournal.com profile] senatorroy says "Kareem was sent to SJA due to a grammatical error within an essay. He forgot to put quotation marks around a quote but he still sited the source giving the website where he got it word for word. But the professor was a hardass and sent him to SJA. Natalia was caught drinking in the dorms." (ii) in response, Elections Committee Chairman Leathers says "Because of an agreement I made with Kareem and Natalia, I'm not going to publicly state what exactly they were put on probation with SJA for, but the reasons listed above are not the reasons given by SJA." (iii) SJA in my experience has always been extremely lenient. Of cases I have known to go there, they've always resulted in the most minimal / understanding arrangement that could have been expected; (iv) in conclusion, we still don't know the full story. I don't want to hear it really, but (v) the student body clearly showed in the Ackerman case that they did not want a senator who had committed an unethical act, so (vi) I think one can pretty reliably say that if people had known the full story, these individuals would not have been elected. (vii) which once again isn't to say I'm against them specifically being placed into office, but I'm seeking to deflate another ridiculous misconception that is being bandied about.


    And Now For Something Completely Different - The Dishwashing Deficit
       I always do dishes by hand because the dishwasher doesn't do the best of jobs. As such I tend to ignore the dishwasher completely. My two roommates, like normal people, like to let the dishes pile up until they can run the dishwasher. Possibly because whenever I do my dishes I try to do one or two more than I made dirty, so as to ensure I'm not running a net cleaning debt, and because I'll just start doing dishes if the pile in the sink has gotten so large I can't use it anymore, I have a feeling I'm doing most of the dishes around here and the other two are growing just to rely on me cleaning the dishes they leave in the sink.
       Some people (mostly on TV it seems) allegedly have jars in which they put a small amount of money every time they do something they're trying not to do, like curse. Phi Alpha Delta has begun collecting money from people who come to meetings late. It occured to me that theoretically one could require that persons depositing dishes into the sink to deposit something like 10 cents per dish into a nearby jar, and persons cleaning dishes could extract the equal amount. This way there's at least a slight motivation to do as many dishes as one makes dirty, or at least one is more aware of their net impact.

       On Saturday Kristy and I went to the party at the Loyola House, which was awesome. Kristy and I hadn't been to a party there in over a year (it used to be the premier party location in Davis). Kristy went as a cheerleader and I wore my black grim reaper cloak as an ambiguous halloween costume. If anyone asked we were going to say we were the Tiger Army song "Who killed the Cheerleader?," but no one asked (which I guess validates the ambiguity of the costume).
       Today, Monday, Halloween itself, there was a party at the Baxter House, an old abandoned house near the Davis airport. This was excellent because that place is only about a furlong from my apartment. It was due to start at 11pm, and as last time they tried to have a party there it got broken up with tremendous asaptitude I wanted to get there as soon as possible.
       Unfortunately I didn't even get back from campus until 11. And then I frantically searched for my cloak to no avail (turns out it was at Kristy's). Quickly I delved into my closet and assembled some kind of Soviet military costume. I think this actually turned out better than my Ambiguous Halloween Costume, but I did the Soviet military thing last year (file photo).
       The Baxter House it turns out is armed with a massive stockpile of old printer paper. Several people began filling a room with this, which at first seemed rather juvenile and vandalistic to me, but then turned out quite awesome when we had a huge pile of paper to frolick in.
       Tomorrow I'm going to go back out there and clean up any bottles and cans that were left behind.

    Thursday I hung out with Carissa and we explored local labyrinthine edifice The Social Science Building, known endearingly as "The Death Star."

       That evening I went to the ASUCD Senate meeting. It was dominated by an extensive debate about whether or not the Senate should pass a resolution urging local businesses not to accept advertising from cigarette companies (or something along those lines). I just listened for logical fallacies in the arguments and desisted from participating. I got on the speakers list during public discussion at the end, but the Senate adjourned before I could speak. I might mention some of my thoughts next week.
       Of particular note though, I was very disappointed in the way more than one senator summarily rejected the comparisons the "pro-smoking" Focite senators (particularly mini-Kalen) were making to alcohol, simply because they said the two things were "different." This you see, was "political correctness" in action. You probably don't think of being anti-smoking as being "politically correct," because it seems like an obvious thing to many people, but when one won't even listen to the arguments against alcohol because you know smoking is condemnable but drinking isn't so much, thats where you're letting PC guide your actions. PC makes taking certain stances condemnable and leads to less intelligent discussion and a generally undesirable political environment (though at the time one will probably not notice if one is themself on the PC train). Don't get me wrong, I am for the gradual elimination of smoking from society, and am against similar treatment of alcohol, but the summary refusal to entertain the Focite proposal offended me.
       Eventually the resolution passed with Rob Roy flipping a coin to decide the crucial vote (video footage!).

    Friday I went to Murder Burger for lunch with Roxie and her friend (Molly?). We saw turtles in Putah Creek and Kalen Gallaghers at Murder Burger (along with Kalen's "hetero lifemate," Behzad).

    Friday night: see Pledging. Also saw The Motorcycle Diaries with Kritsy and Sashie. Its about Che Guevara before he became a radical revolutionary.

    Saturday morning I took the Foreign Service Written Examination (FSWE). A six hour test designed to see if your hand has the endurance necessary to process paperwork while under fire in third world kleptocracies while advocating US policy (from a cubicle). Also Azver was there.


    Pledging
       Monday night we had our first pledge meeting and informed of everything about the process. Wednesday night we met our "big sibs." Mine is a girl I've known for awhile, she was a Senate reporter for KDVS like two years ago I think. I escaped early though because I needed to put together a presentation in Swedish that I had to give the next morning.
       Friday night we had casino night, which I thought was cool because I have no idea how to play poker but would like to learn where money isn't on the line - as in this case. I've found my lack of understanding can almost be advantagious, since obliviousness to the value of ones cards leads to a perfect poker face. At one point I beat someone who had a flush with a better flush, causing them to exclaim "he plays a flush just like a low pair, its insane!!" Fact is though, that I hadn't even looked at my cards until I turned them over. (=
       After a glorious winning streak however, people nickle and dimed me to death until I was only up 12 points.

       Its been more than a week now since I’ve had time to update this livejournal. Aside from being attributable to being shockingly busy, my internet is also to blame, as it has been down ever since I got back from San Fransisco this weekend (I’d been at a Model UN conference but I’ll get to that in due time).

       With ASUCD elections last week, this unusual busy-ness made me unable to write the pro and con for Constitutional Amendment #6 as planned. I was quite looking forward to it, because you see, I was slated to write BOTH the arguments of proponency AND opponency. I was planning on making some harsh personal attacks in the con argument (against myself as author of the pro argument).

       Additionally, an interesting event transpired during the election. I’m not sure how much opinion I can express on it at this time, as I might have appellate jurisdiction over any further decisions the elections committee makes on the subject, but I shall recount here for your consideration the basic facts of the case:

    The Disqualification and Requalification of Mr Robert Roy - an objective recounting
       Expenditure forms are due a week before the election, in which one is to indicate all moneys they have expended on their campaign. Candidate Robert “Rob” Roy turned in an expenditure form that was complete except for some receipts which allegedly were lost when his backpack was stolen. Lacking these, Roy, indicated the costs that would have been reflected in the missing receipts as best he could. In investigating, the Elections Committee contacted the noted businesses and found that he had indeed indicated accurate expenditures. The Elections Committee probably would not have known there were missing receipts if Roy hadn’t himself indicated that there were.
       ASUCD Gov’t Code Section 112 (8) describes “falsifying expenditure forms.” Among the things that may be falsification it mentions “incomplete forms” in subsection A, for which they cited Roy. Subsection B states that if the Committee finds that a candidate falsified their expenditure form, depending upon the severity of the incident the Elections Committee may by unanimous vote disqualify a candidate.
       The Elections Committee announced on the second day of voting that Roy was to be disqualified under these bylaws. No reason was given for exerting the fullest severity of their discretion. The next morning shortly before results were to be announced, they met with the university legal counsel, and then announced that though they stood behind their earlier ruling, they were undisqualifying Roy because they “didn’t want to thwart the will of the students” or something. Roy won by the largest margin in known history.

       Relevant history: Last election, members of the Student Focus party were caught cheating by a number of people, and later found guilty by Student Judicial Affairs. The Elections Committee obstinantly refused to disqualify those involved.

       Questions to Consider: (1) Are the things listed as possible forms of falsification things that are necessarily always falsification or just possible forms of falsification? (2) Under what conditions would one expect the “discretion” to disqualify a candidate pursuant to this bylaw to be found in favour of disqualification? Under what conditions should the discretional disqualification not be exercised?

    Note: The above really does seek to be accurate and objective. If one notices any inaccuracies, the friendly staff here at e.m.o.s.n.a.i.l. would love to rectify it.

    Additional Commentary - commentary on things other than the merits of the disqualification
       (1) Whether or not one thinks the Committee was right in exercising its discretional ability to disqualify, I strongly believe they should have explained their reasoning. “Discretion” isn’t an invitation to make whatever arbitrary decisions one happens to feel like, discretion is leeway to define the conditions considered. (2) The reversal was not based on any kind of legal argument, merely the Elections Committee tried to make themselves sound like “the good guys” and imply they were benevolently bending the rules on Roy’s behalf. Whether or not one thinks the original disqualification was justified, and even if there WERE compelling reasons to reverse the disqualification (I’ll weigh in on these issues once the new senators are sworn in on Thursday), the Elections Committee should still not be bending the rules as they see fit -- they should strive to justify their actions by the rules, not by their own opinions.

    The Journey Home - a 25 hour odyssey
    I. Relatively Distracting
       I finally set off from Davis for Orange County around 5pm, Sunday. First I got gas and stopped by my aunt and uncle, Ben & Bev's place because I wanted to drop off some honey for them. Arriving there however, I find that not only are Ben & Bev there, but two other aunts/uncles (Jim & Donna and Mike & Sherry) and the four associated childrens.
       They offered me dinner but I valiantly resisted. Then I had Mike help me figure out how high the oil was on the oil-checking-thing, and he thought he smelled gas. We dismissed the concerns however and finally I set off.
    II. Pleasantvilleton
       Next I drivemobiled myself down to Pleasanton, about an hour and a half south, where Miss Kristy Heidenberger was with her family. Had dinner there, Kristy made a sumptuous dessert, and I ended up spending the night on the couch there.
    III. The Curse of Coalinga
       Monday (yesterday) I left there around 10am, having waited for morning traffic to disperse, and commenced driving down the central valley. As previously mentioned, the gas gauge does not work, nor does the temperature gauge, and the speedometer and odometer are not visible in the dark as their light went out...
       But it was pleasant. It remained overcast nearly the whole time, which I appreciated, and everything was green. Additionally, Kristy packed me sandwiches for lunch because she's strong sauce like that.
       Then a mile or two from Coalinga, the car died. It just kind of stopped accelerating - it decelerated at the same right regardless of whether or not my foot was on the gas. I pulled over right in front of an onramp, let it chillax for a minute or two, and then successfully reversed it up the onramp (this is in the middle of nowhere mind you, onramp leads to a two lane road with no cars on it). This being relatively successful I drove about the road up there and the car seemed to have no problems. I got back on the freeway and proceeded to Coalinga.
       Pulled in to the same station as last time and filled up with gas. Hamid, the mechanic that removed the rock from Kristy's break, thus averting our fiery death, was there, but fairly busy.
       The gas tank also appeared to be leaking (while I was at the service station talking to mum on the phone, a puddle formed under the car's gas tank), but it wasn't empty and that appears to be an unrelated problem. Recall smell of gas earlier.
       And that wasn't even the first time the car broke down there either. Once before it broke down at Coalinga with Tobin in it. Or maybe it was the other car, but either way, Coalinga appears to be cursed.
       So I set off again and aside from getting mired in rush hour traffic in LA, I arrived without further incident.
    IV. Homecoming
       After being in transit for 25 hours, driving for 8, and in miserable traffic for the previous 2, I arrived home around 6pm to find no one home and all the doors locked.
       Fifteen minutes later they returned (they all scampered off to get something noterized?!), with a mushroom and olive (and other stuff) pizza. I hate olives. I loathe mushrooms.
    V. Postlogue: More Crashing to Come
       Reportedly, younger brother Eric applied his vehicle to the freeway median an hour or two ago. No further word on the effects of this. Developing...

    So I'm here in the computer lab on a sunday because I am utterly beyond addicted to computers. No actually its because I have pressing matters to attend to regarding the ASUCD Supreme Court. We have a case (in case you live in a hole, I am the Chief Justice)!

          Anyway, the weekend:
       Friday Kristy, Christie, Courtney and I went to the Davis Music Scene show at Chem194, but weren't really feelin the vibes so we mosied on.. we accumulated Serena as well and all trooped off to Jackson Pritt's party, because of course Kristy has stars in her eyes when it comes to Jackson.
       Katie Shaw appeared briefly because she was driving by and saw me. That was cool. She and I talked about how very difficult it is to get fired from the Coffee House.. apparently people miss like weeks and don't get fired. ::shakes fist:: what can I say, I have mad skillz.


       On Saturday Kwisty Kwisty took me to Fuzios because I was hellof mad at her about certain things from the day before. mmmmm I love Fuzios. Then we dropped Christie and Serena off at the Mondavi Center*. That accomplished, we met up with Courtney and her sorority sisters Kristi and Elaine; and proceeded with them to a sorority/fraternity party.
       Needless to say, we soon declared that boring and went roving for further entertainment. Eventually we came to Rob Roy's party but it was mainly abandoned at that point. The End.

       *Mondavi Center - the evil project of the UCD Administration to further a number of their nefarious goals with little relation to students. (A) The structure furthered their evil "Operation "New Front Door," an attempt to make the BACK side of UCD the new FRONT side by putting things like the mandavi center there, though this side is not the side any students enter the school from nor near classes. This side faces the freeway and apparently the Administration has some deranged idea that people are likely to attend a school by seeing it from the freeway? (B) the Mondavi center mainly hosts things far out of the price range of students and generally out of their interest range.. hoighty toity operas and ballets and suchforth. Even things students are largely interested in are bought out by the old fogey alumni that the Administration loves so much. Example: Michael Moore is coming. Number of tickets (out of a few thousand total) going to students? appx 100.
